A. 
A Community Recreation Commission ("Commission") for the Township of Grosse Ile ("Township") is established.
B. 
The establishment of this Commission replaces and decommissions the former Recreation Commission and the former Water's Edge Commission.
C. 
The Township Board specifically charges the Community Recreation Commission with authority for and over the objects within the charges of the former Recreation Commission and the former Water's Edge Commission.
A. 
Membership of the Commission shall include the following:
(1) 
Nine individuals who are appointed by the Township Board to serve as Commissioners and who have been legal residents of the Township for at least 30 days prior to membership and remain residents during their appointed terms.
(2) 
One Township Board member selected by the Township Board, who serves as a liaison to the Commission.
(3) 
The Recreation Director, who serves as a nonvoting member and is an employee of the Township.
B. 
The first Commission, as appointed by resolution of the Township Board at its January 24, 2005, meeting, shall consist of the following members:
(1) 
Ten individuals who have been appointed by the Township Board to serve as Commissioners and who have been legal residents of the Township for at least 30 days prior to membership and remain residents during their appointed terms.
(2) 
Two Township Board members, selected by the Township Board, who serve as liaisons to the Commission.
(3) 
The Recreation Director, who serves as a nonvoting member and is an employee of the Township.
(4) 
All Commissioners from this first Commission seeking reappointment may request reappointment from the Township Board for an additional three-year term.
(5) 
Any Commissioners from this first Commission who resign or who do not seek reappointment will not be replaced by the Township Board unless the number of appointment Commissioners falls below the nine, which is the official number of Commission seats as stated in Subsection A(1).
A. 
Unless appointed to fill a vacancy, each Commissioner shall be appointed to serve a term that begins on the date of appointment and expires in the third year of appointment on the last day of the Township's calendar year, i.e., April 1.
B. 
The Commissioners will serve staggered terms.
C. 
There are no limits on the number terms that a Commissioner may serve.
D. 
The terms of the Commissioners of the First Commission are set by the Township Board's resolution of January 24, 2005.
A Commissioner's appointment may be renewed by the Township Board for an additional three-year term.
The Township Board may remove appointed commissioners upon proof by a preponderance of evidence that the accused member committed misconduct or gross neglect of official duties at a hearing before the Township Board. The Commissioner may waive the hearing and submit a resignation as an alternative. See generally Article I, § 67-1A(7) of the Township Code.
The Township Board shall fill vacancies on the Commission created by events other than the regularly scheduled expiration of the Commissioner's term by appointing a new Commissioner who shall serve the remainder of the term held by the Commissioner who has vacated the Commissioner seat.
A. 
Unless provided otherwise, actions by the Commission must be approved by a majority of the membership at a scheduled meeting in which a quorum of members is present. See § 67-1B(1) (majority of the membership constitutes a quorum).
B. 
At the beginning of the Township's calendar year, i.e., April 1, the Commission shall nominate a Chairperson, to be approved by the Township Board. See § 67-1A(2).
C. 
At the beginning of the Township's calendar year, i.e., April 1, the Commission shall select a Vice Chairperson to assist the Chair and act in the Chair's absence and a Secretary to be responsible for Commission minutes. See duties of Vice Chair and Secretary, § 67-1A(3).
Members of the Commission shall serve without compensation but shall be entitled to actual and necessary expenses, approved by the Township Board, incurred in the performance of official duties.
A. 
The Commission shall act as an advisory commission to the Township Board.
B. 
The Commission shall consider, study and make recommendations relative to the development of new programs and shall also consider, study and make recommendations for improvements of existing programs.
C. 
The Commission shall include in its recommendations proposals for the use and/or improvement of the properties within its charge.
D. 
The Commission shall also perform such other acts and duties in connection with the operation of its programs as authorized or directed by the Township Board.
A. 
The Community Recreation Commission shall have general supervision over the maintenance and operation of the Recreation Department, Water's Edge Restaurant, Water's Edge Marina, Water's Edge Golf Course, Water's Edge Driving Range, Water's Edge Swimming Pool, Centennial Farm, Playscape, Airport Recreation Area, and any property owned or leased by the Township that the Township Board delegates to the Commission's charge.
B. 
The Commission shall have the authority to impose all necessary rules and regulations governing the Recreation Department, Water's Edge Restaurant, Water's Edge Marina, Water's Edge Golf Course, Water's Edge Driving Range, Water's Edge Swimming Pool, Centennial Farm, Playscape, Airport Recreation Area, and any property owned or leased by the Township that the Township Board delegates to the Commission's charge.
C. 
The Commission shall have specific oversight authority of the restaurant operations to ensure compliance by the contractor with Township policy and specific contractual obligations.
A. 
Master Plan.
(1) 
The Community Recreation Commission shall consider, study, and recommend an overall Master Plan for the development of programs and use of Commission properties, which will provide benefits for all community members.
(2) 
The Master Plan must be developed in accordance with the basic land use plan and program adopted by the Township Planning Commission.
(3) 
The Master Plan must be reviewed and approved by the Township Board before its effective date.
(4) 
The Master Plan shall cover a span of five calendar years to expire on December 31 of the fifth year.
B. 
The Recreation Master Plan, adopted in January 2001 by Township Board, shall remain in full force and effect until December 31, 2005, as originally enacted.
A. 
Neither the Commission nor its individual members shall incur any expense or create any obligation or liability upon the Township without prior approval from the Township Board.
B. 
The Commission shall review and recommend expenditures for the approval by the Township Board. All Commission purchases must comply with the procedures and regulations stated in Article I, § 67-2, of the Township Code.
C. 
The Commission shall review and recommend an annual budget or annual budgets for the approval by the Township Board. All Commission budgets must comply with the procedures and regulations stated in Article I, § 67-3, of the Township Code.
D. 
The budgets and expenditures, which have received prior approval from the Township Board, for the former Recreation Commission and the former Water's Edge Commission remain in full force and effect as originally enacted.
A. 
The Commission shall request such assistance of other departments of the Township government as may be necessary in the performance of its duties.
B. 
The Commission shall receive assistance of the employees of the Township as may be necessary in the performance of its duties.
C. 
The Commission is authorized to collaborate with other Township governmental departments, the Grosse Ile Township School Board, neighboring municipalities, Wayne County, and the State of Michigan. The Commission may collaborate with these entities to develop new programs, improve existing programs, obtain grant monies, agree on use and/or develop facilities, and consolidate services with the goal of improving the efficiency of Commission operations.
D. 
Nothing in this section authorizes the Commission to act in contravention of the Township Code or public policy or to act without prior Township Board approval as required by law.
A. 
The Commission shall review and recommend contracts or leases for adoption and approval by the Township Board.
B. 
To obtain approval for contracts, the Commission must comply with the bidding procedures of Article I, § 67-2B.
C. 
The Commission may lease to third parties use of the buildings or land under its control in conformity with the master lease of the Township as approved by the Township Board; provided, however, that no occupancy shall be permitted unless or until the Township has issued an appropriate certificate of occupancy for the property in question.
D. 
To obtain approval for leases, the Commission must comply with the procedures of Article I, § 67-3G.
E. 
All contracts and leases which have received prior approval from the Township Board for the former Recreation Commission and former Water's Edge Commission remain in full force and effect as originally enacted.
A. 
At the annual meeting of the Township Board, the Director and Commission Chair shall present an annual report to the Township Board, which advises the Board of the following:
(1) 
Financial reports related to budget performance, liabilities (existing or potential), and millage related expenditures.
(2) 
Annual performance and/or proposed amendments relative to Master Plan.
(3) 
Report on programming, services and projects.
(4) 
Proposed objectives for the upcoming year.
(5) 
Proposed budget(s) for the upcoming year.
B. 
The Director shall prepare for the Township Board an inventory of all equipment under control of the Community Recreation Commission as of the last day of each six months of the fiscal year to be submitted for Township Board review within 30 days of the six-month period.
A. 
The Recreation Director shall serve as a nonvoting, permanent member of the Community Recreation Commission.
B. 
The Commission may evaluate candidates and recommend an individual(s) to the Township Board for the position of Director, whom a majority of the Commission has determined has the education, training, and experience to qualify for the position.
