The Township of Ridley does hereby signify intention to organize an Authority, together with the Townships of Springfield and Nether Providence and the Boroughs of Swarthmore, Rutledge, Morton, Prospect Park and Ridley Park, under the provisions of the Acts of Assembly and the amendments and supplements thereto.[1]

Editor's Note: The joinder of the Township of Marple as a member of the Central Delaware County Authority was approved 9-21-1960 by Ord. No. 1110. That ordinance also approved and set forth the form of application of said Township to become a member, revised the terms of office of the members of the Board of the Authority and authorized the execution of said application.
The proper officers are hereby authorized and directed to organize the said Authority in conjunction with the proper officers of the aforesaid townships and boroughs, and, together with the aforesaid officers, to execute the Articles of Incorporation and to file the same with the Secretary of the Commonwealth of Pennsylvania, as provided by law.
The said Articles of Incorporation shall be as follows:
A. 
The name of the Authority shall be the "Central Delaware County Authority."
B. 
The Authority is formed under the provisions of 53 P.S. § 301 et seq.[1]

C. 
No other Authority organized under the Municipal Authorities Act of 1937 (Act No. 200) nor under the Act approved December 27, 1933 (Special Session, 1933, P.L. 114) is in existence in or for the incorporating municipalities.
D. 
The names of the incorporating municipalities, together with the names and addresses of their municipal officers, are as follows.
E. 
The names and addresses and terms of office of the first members of the Board of the said Authority are as follows.[2]

F. 
Commissioners or Councils, as the case may be, of each municipality creating the said Joint Authority, shall appoint one member of the Board. The Townships of Ridley and Nether Providence shall appoint one member each for a period of four years; the Borough of Swarthmore and the Township of Springfield, for a period of three years; the Boroughs of Ridley Park and Prospect Park, for a period of two years; and the Boroughs of Rutledge and Morton, for a period of one year. Thereafter the said Commissioners or Councils, as the case may be, shall, at a meeting held not later than one month prior to January 1 in each year in which a vacancy occurs in the office filled by that municipality, appoint as a member of the Board a citizen of that municipality for a term of four years to succeed the member whose term expires on January 1 next succeeding.[3] All vacancies shall be filled by the governing body of the municipality whose appointee has vacated his office.
The term of existence of the Central Delaware County Authority shall be for a period ending June 1, 2055.[4]
IN WITNESS WHEREOF the municipalities appointed herein have hereunto caused to be written their respective names, signed by their presiding officer and attested by their Secretary or Clerk, this 13th day of November A.D. 1937.

Editor's Note: The preceding provisions were revised by the application of the Township of Marple to become a member of the Authority (approved 9-21-1960 by Ord. No. 1110). The last paragraph of Subsection G of said application provided as follows:
"Whenever a vacancy in the Board has occurred by reason of death, resignation or otherwise, or is about to occur by reason of the expiration of the term of a member, the municipal authorities of the municipality which appointed the member whose term has expired or is about to expire shall appoint a member for a term of five years to flu the vacancy occurring by reason of the expiration of a term and for the unexpired term when the vacancy has otherwise occurred. Members whose terms have expired shall hold office until their successors have been appointed and may be appointed to succeed themselves."

It is provided, however, that unless the Townships of Springfield and Nether Providence and the Boroughs of Swarthmore, Rutledge, Morton, Prospect Park and Ridley Park, each and all of them, pass similar ordinances, then the Township of Ridley shall not be bound by any provisions of this article, which shall be, in that event, without force and effect.[1]

Editor's Note: A supplemental agreement, dated August 17, 1960, between the Central Delaware County Authority and the incorporating municipalities, was approved by the Township of Ridley 9-21-1960 by Ord. No. 1111. It provided for:
"(1) The construction by said Authority of an extension to Its trunk line sewers;
"(2) The operation and maintenance by the Authority of said extension;
"(3) Certain payments by the Township of Marple to the other municipalities and to Baldwin-Lima-Hamilton Corporation for the use of the Authority's sewer system;
"(4) Payments by the Township of Nether Providence and the Township of Springfield of a portion of the total cost of constructing and equipping said Improvements; and
"(5) Payment by the Township of Marple of certain charges for the use of said Improvements;" and authorized the execution and delivery of said supplemental agreement on behalf of the Township of Ridley.

The proper officers are hereby authorized and directed to organize the said Authority in conjunction with the proper officers of the aforesaid Townships and boroughs, and, together with the aforesaid officers, to execute the Articles of Incorporation and to file the same with the Secretary of the Commonwealth of Pennsylvania, as provided by, law.

The Borough of Glenolden and the Township of Ridley shall appoint one member each for a period of four years from the first of January 1939; the Township of Springfield and the Borough of Norwood, for a period of three years from the first of January 1939; the Township of Upper Darby and the Borough of Folcroft, for a period of two years from the first of January 1939; and the Borough of Clifton Heights, for a period of one year from the first of January 1939, all the said terms to start immediately upon the granting of certificate of incorporation by the Secretary of the commonwealth. Thereafter the said Commissioners or Councils, as the case may be, shall, at a meeting held not later than one month prior to January 1 in each year in which a vacancy occurs in the office filled by that municipality, appoint as a member of the Board a citizen of that municipality for a term of four years to succeed the member whose term expires on January 1 next succeeding. All vacancies shall be filled by the governing body of the municipality whose appointee has vacated his office.
