The town may adopt reasonable charges and fees for reimbursement of costs of setting up and operating the town's pretreatment program which may include:
A. 
Fees for wastewater discharge permit applications, including the cost of processing such applications.
B. 
Fees for monitoring, inspection and surveillance procedures, including the cost of collection and analyzing an industrial user's discharge and reviewing monitoring reports submitted by industrial users.
C. 
Fees for reviewing and responding to accidental discharge procedures and construction.
D. 
Fees for filing appeals.
E. 
Other fees as the town may deem necessary to carry out the requirements contained herein. These fees relate solely to the matters covered by this Part 2 and are separate from all other fees, fines and penalties chargeable by the town.
A. 
If the volume or character of the waste to be treated does not cause overloading of the wastewater facilities, then the person making the discharge shall pay a user charge to be determined from the schedule of charges. The user charge assessed to the discharger pursuant to this section shall include but not be limited to the user's proportionate share of the following:
(1) 
Amortization of all applicable capital outlays for collecting and treating the waste, including new capital outlays and the proportionate part of the value of the existing wastewater facilities used in handling and treating the waste.
(2) 
Operation and maintenance costs, including salaries and wages, power costs, costs of chemicals and supplies, proper allowances for maintenance, depreciation, overhead and office expenses.
B. 
If the volume or character of the waste to be treated requires that wastewater facilities be improved, expanded or enlarged in order to treat the waste, then prior to issuance of a wastewater discharge permit, the Commissioners and the person responsible for the discharge shall enter into an agreement which provides that the discharger pay in full all added costs that may be incurred due to acceptance of the waste.
C. 
A user charge shall be adopted based on the wastewater constituents and volume. The charges for wastewater constituents and characteristics shall be established by the Commissioners and set forth in the schedule of charges and fees.
D. 
Each user, not required to obtain a wastewater discharge permit, shall pay the applicable user charge as established and set forth in the schedule of user charges and fees.
E. 
Users who are issued a wastewater discharge permit under the provisions of these regulations shall pay user charge determined by a methodology which incorporates both the wastewater constituent and the volume of wastewater discharged.
F. 
The schedule of charges adopted by the Commissioners shall be posted separately and are subject to review and potential revision at intervals not exceeding two years.
G. 
In applying the schedule of charges, the Commissioners may use the figure representing the flow discharged into the sewer system by:
(1) 
The amount of water supplied to the premises as shown upon the water meter, if the premises are metered;
(2) 
The volume of wastewater discharged into the sewer as determined by the measurement by sewer meters and samples taken at the control manhole installed by the user of the property served by the sewer system;
(3) 
Allowance for employees; or
(4) 
A figure determined by the Commissioners by any combination of the foregoing or by any other equitable method.
H. 
One or more of the above methods for flow determination shall be selected so that the most accurate volume values are used. The method or methods utilized shall be mutually agreed upon by the Commissioners and the user, unless specifically called out in a wastewater discharge permit.
I. 
The constituent concentrations of any wastewater shall usually be determined from representative samples discharged to the public sewers. The intent of any sampling procedure is to establish the constituent concentrations in the wastewater discharged during an average or typical working day.
J. 
Permitted dischargers shall be sampled in accordance with their permit.
