It is the intent and purpose of this Zoning Ordinance to provide that the C-1 Business Zone District shall serve as the principal retail and service area of the Borough, accommodating shopping and business needs customary in a residential community. The zone is intended to serve the following functions: to provide convenience goods and services to the Borough and its residents; to provide consumer goods and services usually attendant to the needs of a residential community; and to provide office uses which complement and support the business uses and which are customarily attendant to the needs of a residential community.

In the C-1 Business Zone District, no building or premises shall be used and no building or part of a building shall be erected, constructed or altered which shall be arranged, intended or designed to be used for any purpose other than the following uses:
A. 
Any use permitted in the A, AA, AAA or B Zone Districts; provided, however, that no residential use shall be permitted below the level of the second floor in any structure.
B. 
Shops or stores for retail merchandising, provided that there are no fabricating, manufacture, conversion, alteration or assembling operations permitted, except as may be only incidental to the particular retail trade to be conducted.
C. 
Restaurant, tavern or ice cream parlor, shops rendering a retail service, such as a baker, barber, cleaner, hairdresser, cobbler, tailor, milliner or other retail service, appliance sales and their incidental repair or servicing.
D. 
Banks, savings and loan associations, real estate or insurance agents or brokers, travel agents or professional service offices, such as doctor, lawyer, accountant, architect, artist, schools of dance or music or government offices.

The C-1 Business Zone District is intended to be used for retail sales and service only. Accordingly, all uses not specifically permitted are prohibited. Without intending to limit the application of this provision, the following uses are specifically prohibited:
A. 
Subject to the provisions of § 270-66D aforesaid, office uses whose primary principal activity is other than on-site sales or service to retail consumers or professional services.
B. 
Repair facilities, including body shops, automobile repair shops or shops, businesses or uses whose major activity is the fabrication, repair, manufacture or assembly or storage of equipment, machinery or other products and any repairs not incidental to a retail sales or service activity.
C. 
General executive business and nonretail sales and service offices are prohibited within the business zone district. Corporate headquarters, regional and sales offices and similar offices are specifically excluded from this zone district.
D. 
No uses permitted in this zone shall be conducted out of doors except licensed outdoor cafes.

E. 
Drive-through style fast-food restaurants primarily engaged in the sale of foods for off-premises consumption.
F. 
No unattended business or any business of a laundry, dry-cleaning establishment, self-service laundry, bakery or repair shop where any one of the same shall employ more than six persons or use machinery having a cumulative horsepower rating of more than 20 is permitted.

Within this zone district, any and all businesses, together with the appurtenant uses thereof, including warehousing and storage, shall be conducted entirely within a permanent, enclosed roofed structure which shall comply with the Building Code[1] of the Borough of Allendale, except licensed outdoor cafes. No warehousing or storage is permitted except insofar as it is ancillary and incidental to the primary and intended uses conducted lawfully on the premises.

A. 
Height. Notwithstanding any other provision of this chapter to the contrary, no building or structure shall exceed a maximum of two stories or 28 feet in height, whichever is lesser; provided, however, that a parapet wall or walls shall be permitted a maximum height of 35 feet if the width of the portion of such wall or walls over 28 feet high does not exceed 25% of the total width of the building facade devoted to the use in question.

B. 
Front yard. There shall be a front yard of not less than 42 feet from the center line of the street.
C. 
Side yard. All business buildings may be built without side yards, except that where a business zone district adjoins a residence zone district, there shall be a minimum side yard of 10 feet.
D. 
Rear yard. There shall be a rear yard of at least 24 feet where property abuts any residence zone district, provided that where an alley separates the business zone district from the residential zone district, the full alley width may be counted as part of the required yard.
