Hereafter no person shall discharge a revolver or pistol of any description, shotgun, rifle or air gun, gas-operated gun or spring gun or any other firearm or device for the discharge of projectiles of any type, in the Borough of Beach Haven; and no person shall have any of the firearms or devices in his possession, except within his own domicile or pursuant to a lawfully issued permit or license therefor.
A. 
Hereafter it shall be unlawful for any person to:
(1) 
Cast, throw, light or fire any squib, rocket, torpedo, grenade, gun, revolver, pistol, cap or cartridge or other combustible firecrackers or fireworks of any kind.
(2) 
Exhibit, or have in his possession with intent to give away, or sell or offer for sale within the Borough any squib, rocket, torpedo, grenade, revolver, pistol, cap or other combustible firecrackers or fireworks of any kind.
B. 
The prohibitions of this section shall not apply to the sale, storage or use of flashlight composition by photographers or dealers in photographic supplies, nor shall they prevent any public display of fireworks of any kind if conducted under proper police supervision after application made and permit issued by the Borough Manager for such demonstration.
The provisions of §§ 98-1 and 98-2 shall not apply to any police officer in the performance of his or her lawful duties.
A. 
Hereafter, it shall be unlawful for any person to:
(1) 
Suffer, allow or permit any open flame or any flame which is not enclosed in a protective device to keep the same from igniting flammable material in close proximity thereto.
(2) 
Permit any flame to be borne by wind, air currents, or any other manner, including being carried by a person to be transported in such manner that said flame has the capability of igniting any flammable substance which comes within close proximity of such flame.
B. 
Specifically, sky lanterns, aka kongming/wish lanterns, are hereby prohibited in the Borough of Beach Haven.
(1) 
Sky lanterns, aka kongming/wish lanterns, are specifically defined as airborne paper lanterns that are constructed of oiled rice paper or other flammable material on a bamboo or similar flammable frame which contain a small candle, a fuel cell composed of waxy flammable material or any other source of flames. Such sky lanterns, aka kongming/wish lanterns, are specifically designed so that when the flame inside the lantern heats the air inside the lantern the lantern rises into the air.
Any violation of this article shall be punished pursuant to the general punishment provisions contained in § 1-16 of the Code of the Borough of Beach Haven.
