The short title by which this chapter shall be known shall be the "Tower Ordinance of the Borough of Beach Haven,"
It is the purpose and intent of this chapter that the Borough of Beach Haven and that all of the residents and property owners of and in the Borough of Beach Haven have as much advance notice as possible of any proposal to erect any tower designed for or utilized for the broadcast of ionizing or nonionizing radiation in order to determine their rights and to develop an orderly method and opportunity for comment on the proposed tower to the Federal Communications Commission or any other appropriate regulatory board or body.
A. 
Any person, firm or corporation who files an application with the Federal Communications Commission or any other state or federal board, body, agency or commission entitled to regulate the broadcast of ionizing or nonionizing radiation, telecommunications, radio broadcasts or any similar transmission shall file within three days of mailing or delivering such application to the Federal Communications Commission or any other appropriate regulatory board, body or agency interstate or federal, a complete copy of the application with the Borough Clerk of the Borough of Beach Haven.
B. 
Any person, firm or corporation who receives a written acknowledgement from the Federal Communications Commission or any other state or federal board, body, agency or commission entitled to regulate the broadcast of ionizing or nonionizing radiation, telecommunications, radio broadcasts or any similar transmission shall, upon the receipt of the written acknowledgement, file a copy of that written acknowledgement with the Clerk of the Borough of Beach Haven within three days of receipt of the same by such person, firm or corporation.
C. 
Any person, firm or corporation who files an application with the Federal Communications Commission or any other state or federal board, body, agency or commission entitled to regulate the broadcast of ionizing or nonionizing radiation, telecommunications, radio broadcasts or any similar transmission shall provide a copy of all correspondence to or from such Federal Communications Commission or any other state or federal board, body, agency or commission entitled to regulate the broadcast of ionizing or nonionizing radiation, telecommunications, radio broadcasts or any similar transmission with the Municipal Clerk of the Borough of Beach Haven and shall do so within three days of the mailing, delivering or receipt of the same.
Upon receipt of any filing as required in § 187-3 above, the Clerk of the Borough of Beach Haven shall forthwith disseminate copies of the same or, in the event the same exceeds 10 pages in length, a synopsis of such filings to the official newspapers of the Borough of Beach Haven and shall further place a notice in the official newspapers that the filings may be inspected in the Borough Clerk's office during normal business hours.
