There is hereby created a Department of Recreation.
The Director of Recreation shall administer and enforce all laws, ordinances and regulations relating to recreation. The Director of Recreation shall have had experience of a responsible nature in recreational work or recreation administration and shall:
A. 
Administer and operate municipal playgrounds, playfields and facilities for indoor and outdoor sports, athletics and recreational programs and activities for children and adults.
B. 
Sponsor and administer cultural and recreational programs and activities and organizations, as recommended by the Recreation Advisory Committee.
The Director of Recreation, with the approval of the Mayor and Council, may adopt suitable rules and regulations for the safety and conduct of persons using recreational facilities and for the preservation of public peace and order at public events. Any person who shall violate any such rule or regulation shall be punishable by penalties not in excess of those authorized by N.J.S.A. 40:49-5. The Department of Recreation may charge and collect, for the use of the Borough, a reasonable fee for admission to programs or activities or use of facilities provided under this chapter when specifically authorized by resolution of the Council.

A. 
The Charter Club shall be in good standing with its national or regional organization, and shall conduct itself in accordance with the rules and regulations of that organization so as to remain in good standing. A copy of all published rules of the organization must be filed with the Recreation Director at least 30 days prior to the start of annual club activity and updated on an annual basis.
B. 
A copy of the Charter Club's current bylaws, policies or other operating documents shall be on file with the Recreation Director.
C. 
The Charter Club shall provide proof of insurance in the form of a valid certificate of insurance naming the Borough of Florham Park as an additional insured, to be filed with the Borough Administrator at least 30 days prior to the start of annual Club activity. The Charter Club shall release and hold harmless and indemnify the Borough of Florham Park and the Recreation Department from any and all payments, expenses, costs, attorney fees and from and for any and all claims and liability for losses or damage to property or injuries to persons occasioned wholly or in part by or resulting from any acts or omissions by the Charter Club or its agents, participants, members, directors, officers, guest, licensees, invitees or for any cause or reason whatsoever arising out of or by reason of the use of Borough recreational facilities by the Charter Club.
D. 
The Charter Club shall provide the Recreation Director with a list of all officers and members of the Club's grievance committee within 15 days of their appointments, including names, addresses, e-mail addresses, phone and fax numbers.
E. 
The Charter Club shall provide the Recreation Director a list of all current participants in the Charter Club, including names, addresses and phone numbers prior to the start of each season and update the list as changes are made.
F. 
The Charter Club shall provide a list of coaches, including names, addresses, e-mail addresses, phone and fax numbers to the Recreation Director at least 30 days prior to the start of the Club's season. All coaches must be NYSCA certified. Failure to hold a current certification will prohibit the individual from coaching at any level.
G. 
In order to utilize Borough fields and facilities efficiently, and to minimize any potential conflicts in field use, practice schedules must be filed with the Recreation Director at least 30 days prior to the start of the Charter Club's season and game schedules must be filed as soon as they are available prior to the start of the season. It is the desire of the Borough to work cooperatively with the Charter Club scheduling representatives so as to coordinate and best meet the needs of various users of fields and facilities. The schedule will include practice schedules, travel team and intramural schedules, as well as coaches responsible during those scheduled times. All schedules are subject to the approval of the Recreation Director and may be subject to alteration based on availability of facilities.
H. 
Each Charter Club shall establish a grievance committee, separate and apart from its board of directors. The purpose of the grievance committee is to handle grievances by Club members and participants. All grievances must first be considered by the Charter Club's grievance committee. Any unresolved matters may then be submitted to the Recreation Director. Matters not resolved at that level may be referred to the Borough Administrator. Either party may appeal the decision of the Borough Administrator to the Borough Council whose decision shall be final. Matters other than alleged violations of the Charter Club's bylaws or the provisions of this section shall be adjudicated solely within the organization.
