[Amended 2-9-1971 by Ord. No. 2-71; 9-19-1995
by Ord. No. 10-95]
A. No licensee shall sell, serve, deliver or allow, permit
or suffer the sale, service or delivery of any alcoholic beverage or permit
the consumption of any alcoholic beverage on licensed premises between the
hours of 2:00 a.m. and 7:00 a.m., except New Year's Day of each year.
B. No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage or permit the consumption of any alcoholic beverage on licensed premises on January 1, commonly called "New Year's Day," between the hour of 5:00 a.m. and the hour designated in Subsection
A when sales may be resumed.
C. During the hours when the sale of alcoholic beverages is prohibited by Subsections
A and
B, the entire premises licensed under a plenary retail consumption license shall be closed, and no member of the public shall be permitted to enter or remain thereon, provided that this requirement shall not be deemed to prohibit the licensee and bona fide employees of the licensee from remaining on the premises for purposes of counting the cash and cleaning the premises, nor shall this section be deemed to prohibit the licensee and his family or bona fide employees of the licensee, who are regular and bona fide residents in the licensed premises, from remaining upon the premises for purposes of such residence. The exceptions are:
(1) Hotels; restaurants. Hotels and restaurants may continue
their normal operations exclusive of the sale, serving or delivery of or consumption
of alcoholic beverages during such hours when that activity is prohibited,
and there shall be no consumption of alcoholic beverages permitted by the
hotel or restaurant in any public area, eating room or bar of the facility
during the prohibited hours.
(2) Clubs. Clubs and organizations holding plenary retail consumption licenses also known as "club licenses" shall be specifically controlled by Subsection
C(1) above, and, while their regular business hours are not affected by this section, the sale, servicing, delivery or consumption of alcoholic beverages is prohibited in any area of the licensed premises during the prohibited hours, and all bars or barrooms shall be closed to the public or members during those prohibited hours.
D. The hours mentioned in this chapter refer to prevailing
time.
