As used in this chapter, the following terms
shall have the meanings indicated:
ANIMAL CONTROL AUTHORITY
Any person or agency designated or certified by the State
of New Jersey to enforce the provisions of this chapter.
CAT
Any member of the domestic feline species; male, female or
neutered.
CAT OF LICENSING AGE
Any cat which has attained the age of seven months or which
possesses a set of permanent teeth.
CATTERY
Any room or group of rooms, cage or exhibition pen, not part
of a kennel, wherein cats for sale are kept or displayed.
LICENSING AUTHORITY
The Borough Clerk or other official designated by the Borough
Council to administer the issuance of licenses under the provisions
of this chapter.
NEUTERED
Rendered permanently incapable of reproduction as certified
by a licensed veterinarian.
OWNER
When applied to the proprietorship of a cat, includes every
person having a right of property (or custody) in such cat and every
person who has such cat in his/her keeping or who harbors or maintains
a cat or knowingly permits a cat to remain on or about any premises
occupied by that person.
PERSON
Any individual, corporation, partnership, organization or
institution commonly recognized by law as a unit.
No person shall hinder, molest or interfere
with anyone authorized or empowered to perform any duty under this
chapter.
No person shall abandon any cat, no matter what
its age may be, within the Borough.
Any officer or agent authorized or empowered
to perform any duty under this chapter is hereby authorized to go
upon any premises to seize for impounding any cat which he/she may
lawfully seize and impound when such officer is in immediate pursuit
of such cat, except within the premises of the owner of the cat if
the owner is present and forbids the same. In that situation, an appropriate
warrant may be obtained in the interest of the health, safety and
welfare of the Borough.
In addition to other penalties and sanctions
of this Code, any person who violates or who fails to refuse to comply
with this chapter shall be liable to a penalty of not less than $10
for each offense. to be recovered by and in the name of the Borough.
