It shall be unlawful for any person to erect or construct or install
a drainage ditch, culvert, drain pipe, bridge or any other type of drainage
structure or obstruction affecting the drainage of any premises in the Borough
without first obtaining permission therefor from the Borough Engineer.
A. This chapter applies to drainage activity by property
owners outside of the Borough Planning Board and Board of Adjustment review
process.

Applications for permission under §
113-1 shall be submitted in writing to the Borough Engineer and shall include the following:
A. A map or diagram of the property, with the location of
all present or proposed ditches, streams, brooks, pipes and drainage structures.
B. Elevations based on United States Geodetic data of all
such features shown.
C. The percent of grade of the flow line of the proposed
drainage structure, pipe or other construction.
D. The disposition which will be made of the water being
drained or channeled from the premises.
The application under §
113-2 and site shall be examined by the Borough Engineer for its compliance with the master drainage system of the Borough. In passing upon such applications, the Borough Engineer shall require that all drainage structures which drain water off the premises of the applicant shall be extended and tied into storm drains, ditches or other existing governmentally owned or controlled drainage for the area. He shall also require that the pipe or structure, taking into consideration the size of the area to be drained, shall be of adequate size and installed to the proper grade. If all standards are complied with and the drainage pipe or structure meets good construction and engineering practice, permission shall be granted by the Engineer.
All drainage ditches, culverts, drains, pipes and drainage structures
shall be kept open and free flowing at all times. It shall be unlawful for
any person to throw or place any debris or material of any manner whatsoever
or to cause such to be thrown or placed into any drainage ditch or drainage
structure under the control of the Borough or any municipal, county, state
or federal governmental agency.
