The provisions of this chapter shall be deemed to be supplemental to
the provisions of the statute with respect to Health and Vital Statistics
(N.J.S.A. 26:3-31 et seq.) and the State Sanitary Code (as revised and enacted
in June 22, 1953, by the Public Health Council of the state), including any
changes or additions which may have been or which may hereafter be enacted.
For the purposes of this chapter, the following words and phrases shall
have the meanings respectively ascribed to them by this section:
The number of bacteria as determined by Standard Methods, American
Public Health Association.
Any dwelling or building where one or more children under the age
of 18 years are housed without the presence of their parents or legal guardians.
The Board of Health of the Borough of Florham Park.
Any person who is a bearer or transmitter of communicable disease
germs without manifest symptoms and is himself immune to the disease.
As applied to animals, the restriction of the animal to the premises
of the owner or other approved institution for the purpose of avoiding contact
with other animals or persons.
Those diseases specified in the list enumerated in the State Sanitary
Code or by declaration of this Board.
The Health Officer, the Sanitary Inspector and any other official
authorized by the Board of Health to enforce this code.
A room occupied by one or more persons living as a single housekeeping
unit, as distinguished from a group occupying a boardinghouse, lodging house,
club, fraternity or hotel.
Every article used as food or drink for human consumption and every
ingredient of such article, and shall include milk and ice cream, preparations
of milk and cream, confectionery and condiments.
Any bakery, bar or cocktail lounge, cannery, confectionery, creamery,
convenience store, dairy, delicatessen, grocery, hotel, lunchroom or luncheonette,
meat market, restaurant, soda fountain, vending machine or other place used
in the production, preparation, manufacture, packing, storing, transportation,
selling, serving, processing or handling of food for human consumption, intended
for sale or distribution or use.
Any furnace, incinerator, refuse-burning equipment, boiler, apparatus,
device, mechanism, stack or structure used in the process of burning fuel,
refuse or any other combustible material.
Every accumulation of animal or vegetable matter, liquid or otherwise,
that attends the preparation and serving of food and the decay and spoilage
that attends dealing in or storage of meats, fish, fowl, birds, fruits or
vegetables.
An apparatus in which the combustion of liquid or solid fuel takes
place.
The placing apart of a person or animal affected with or exposed
to a communicable disease for the purpose of preventing contact with other
persons or animals and the establishment of restrictions directly surrounding
such persons or animals.
The permission, in writing, of this Board, issued according to its
usual practices with respect to particular activities, as required by this
Board or by any law.
Any act or failure to act or the continuance of conditions which,
in the opinion of the Board, are prejudicial to the health and well-being
of the residents of the Borough and is so declared, including particularly
such specific nuisances as are set forth in this Sanitary Code or in subsequently
issued amendments or regulations, and such further acts or conditions as are
declared to be nuisances under the State Sanitary Code and Regulations.
Any house or other place where five or more children under the age
of six years are received, cared for or kept, unattended by either of their
parents or legal guardians, for the purpose of providing such child or children
with food or lodging or instruction or supervision, for periods less than
one day. This shall not include care by any person of a child related by blood
or marriage or care of a child by any institution maintained by the state
or by any municipality or by any incorporated charitable society or a nursery
school maintained by a religious organization and carried on in its buildings
used for religious and related purposes.
Any fire wherein the products of combustion are emitted into the
open air and are not directed thereto through a stack or chimney.
A declaration or statement issued by the Board to interpret, to modify
or to amplify the provisions of this Sanitary Code and all amendments thereto,
for more effective administration incident to the work of the Board or for
proper coordination with the State Sanitary Code and its regulations.
The chart set forth in Article III hereof, known as the "Ringelmann Smoke Chart," published by the United States Bureau of Mines.
The residue of any material used as fuel for heating or cooking purposes
after combustion has taken place; broken or discarded crockery; glassware;
rags; household utensils; house sweepings; bottles; tin cans; lawn and garden
clippings; weeds and discarded shrubbery; but not building material or fixtures,
earth or stones.
Small gasborne and airborne particles in sufficient number to be
observable arising from a process of combustion.
A flue, conduit or opening permitting particulate or gaseous emissions
into the open air or constructed or arranged for such purpose.
A.
All places or premises shall be subject to inspection
at least once a year, at a reasonable hour by the Sanitary Inspector or Health
Officer, when he has reason to believe that any section of this chapter or
of the State Sanitary Code is being violated.
B.
It shall be unlawful for any person to hinder, obstruct,
delay, resist or prevent the Sanitary Inspector from having full access to
any place or premises as to which an inspection is being made.
A.
Whenever a nuisance, as declared by Article II of this chapter, is found to exist on any plot of land, lot, right-of-way or any other private premises, structure or place, notice, in writing, shall be given to the owner thereof to remove or abate the same within such time as shall be specified in the notice. The time fixed for compliance shall be a reasonable time under all of the circumstances.
B.
If the owner resides out of the state or cannot be found,
such notice shall be left at that place or premises with the tenant or occupant
thereof or posted on the premises, and such action shall be considered proper
notification to the owner, tenant and occupant thereof.
C.
If the owner, tenant or occupant, upon being notified
as provided by this chapter, shall not comply with such notice within the
time specified therein and fails to remove or abate such nuisance, the Board
of Health may proceed to abate the nuisance or may cause it to be removed
or abated in a summary manner, by such means as the Board shall deem proper,
and all expenses incurred incident thereto shall be paid by the owner, tenant
or occupant who failed to abate the nuisance.
D.
Upon failure to pay such expenses so incurred, the Board
of Health may institute an action at law to recover the money.
A.
All permits and licenses required by this chapter, except those referred to in Article VI of this chapter, shall expire on December 31 of each year.
B.
Renewal permits and licenses shall be issued upon application
and compliance with requirements of this chapter and regulations of the Board
of Health.
C.
No permit or license may be transferred.
Whenever, in this chapter, any provisions or whenever any subsequently
issued regulation of the Board of Health shall be found to be contrary to
or inconsistent with the State Sanitary Code, regulations or rules of the
State Department of Health in effect now or as may hereafter be adopted, the
provisions of the State Code, regulations and rules shall control.
