No person, firm or corporation shall transport,
in bulk, household furniture, office furniture, machinery, equipment,
fixtures, personal property or other goods and chattels in bulk, from
any premises within the Borough of Ridgefield, without a permit therefor
having been issued by the Police Department of the Borough of Ridgefield.
Application for such permit is to be made in
writing to the Police Department upon official forms supplied by the
Borough of Ridgefield at least 48 hours prior to the issuance thereof.
Saturdays, Sundays and holidays shall not be computed in determining
the forty-eight-hour waiting period.
Said application shall contain the following
information:
A. The name or names of the person, firm or corporation
owning or claiming to own such household furniture, office furniture,
machinery, equipment, fixtures, personal property or other goods and
chattels in bulk which are to be transferred and removed.
B. The street and house number of the respective premises
from which said household furniture, office furniture, machinery,
equipment, fixtures, personal property or other goods and chattels
in bulk are to be removed.
C. An enumeration and brief description of the personal
property to be transported and removed.
D. The name and address of the person, firm or corporation
who or which will actually engage in the transportation or removal
of the enumerated and described personal property.
E. The name or names and address or addresses of the
person, firm or corporation to whom or to which the enumerated and
described personal property is to be transported.
It shall be the duty of the officer witnessing
the application to forward a copy forthwith to the office of the Collector
of Taxes, the office of the Assessor and any other designated official.
Upon the execution of the foregoing application
and the expiration of 48 hours, as hereinbefore defined, a permit
shall issue for the transportation or removal of the enumerated and
described personal property, which said permit shall be and remain
in the possession of the person, firm or corporation actually engaged
in the transportation or removal of the enumerated and described personal
property or that of his agent or servant so engaged, which permit
shall, upon request, be shown to any police officer or official of
the Borough of Ridgefield.
No person, firm or corporation shall, for the
purpose of obtaining the herein-mentioned permit, set forth in the
application for said permit a fictitious name or fail or refuse to
give the correct name of the owner and/or the person, firm or corporation
to whom or to which the enumerated and described personal property
is to be transported or give a fictitious name or fail or refuse to
give the correct name of the owner and/or the person, firm or corporation
to whom or to which the enumerated and described personal property
is to be transported to the person, firm or corporation or its agent
or employee who or which is engaged in the actual transportation or
removal of the enumerated and described personal property.
No person, firm or corporation shall, for the
purpose of obtaining the herein-mentioned permit, set forth in the
application for said permit a fictitious address or fail or refuse
to give the correct address of the owner and/or the person, firm or
corporation to whom or to which the enumerated and described personal
property is to be transported or give a fictitious address or fail
or refuse to give the correct address of the owner and/or the person,
firm or corporation to whom or to which the enumerated and described
personal property is to be transported to the person, firm or corporation
or its agent or employee who or which is engaged in the actual transportation
or removal of the enumerated and described personal property.

A. If this chapter of the Code of the Borough of Ridgefield
provides for the licensing or permitting of the violator, the Mayor
and Council of the Borough of Ridgefield reserve the right to revoke
such permit or license.
B. Any person found guilty of violating this chapter
of the Code of the Borough of Ridgefield shall be subject to a penalty
consisting of a fine or imprisonment, or both, subject to the discretion
of the Judge, the maximum of which shall be the maximum fine or term
of imprisonment permitted to be imposed by the court having jurisdiction
over the violation of this chapter of the Code of the Borough of Ridgefield;
provided, however, that the fine shall not be less than $100 nor more
than $2,000 per offense and the prison term shall not exceed 90 days
in accordance with N.J.S.A. 40:49-5.
C. In the event of a continuing violation, each day shall
constitute a separate offense.
