The fireworks and explosives ordinance heretofore adopted on the 28th
day of March 1939, be and the same hereby is repealed, rescinded and annulled.

It shall be unlawful for any firm, corporation, company or person to
keep, store, transport or have in their possession any high explosives, fuse
or electric blasting caps, fireworks of any description or any other explosive
compound except such articles as defined by the United States Department of
Transportation regulations for the transportation of explosives or other dangerous
articles, without first obtaining the approval of the Public Safety Bureau
of the Nassau County Police Department, a permit in accordance with the provisions
of Section 458 of the Labor Law of the State of New York and a permit from
the Town Clerk of the Town of North Hempstead.
No person, firm or corporation shall sell, expose for sale or give away
any loaded cartridges, blank cartridges, caps, percussion caps, fuse or electric
blasting caps, dynamite, firecrackers or other fireworks or other explosive
materials of any description without first obtaining a permit from the Town
Clerk of the Town of North Hempstead.
No person shall discharge any firearms, rockets, gunpowder, firecrackers, torpedoes, blasting caps, dynamite or other explosives within the Town of North Hempstead, except that persons having a duly issued license or permit to carry or possess concealed weapons and persons having duly issued gunning or gaming licenses or permits shall not be required to first obtain the permit hereinbefore mentioned in §
19-3 hereof before using such firearms so permitted within the intent of such license or permit.

No permit hereunder shall be issued without first obtaining the approval of the Bureau of Public Safety of the Nassau County Police Department, in writing, and a permit from the Industrial Commissioner of the State of New York as referred to in §
19-2 of this ordinance, and a copy of each approval and permit shall be attached to any application for a permit hereunder.

No permit for the keeping, storing or transporting or possession of
any high explosives, fuse or electric blasting caps shall be issued except
upon the payment of the following fees: all permits, fifteen dollars ($15.);
provided, however, that there shall be no fee for the issuance of a permit
to a school or educational institution approved by the Board of Regents of
the State of New York. Such permit when issued shall be in force from the
date of issue until the end of the calendar year.
A person, firm, corporation or company violating this ordinance shall
be liable to a penalty of fifty dollars ($50.) which may be recovered by the
town in action in the District Court. District Judges shall have jurisdiction
to hear, try and determine complaints for the violation of said ordinance,
rules and regulations and to impose a fine equal to the penalty prescribed
by said ordinance for the violation of same, and to commit any person convicted
of a violation of said ordinance, rules and regulations to the county jail
in case of default of payment of a fine imposed for such violation for a term
not exceeding one (1) day for each and every dollar of such fine.
