A. 
Any person found guilty of violating any or all provisions of Article I shall be fined in an amount not exceeding $500. Each day such violation or violations are committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
B. 
Any person found guilty of violating any or all provisions of Article II shall be punishable as follows:
(1) 
For conviction of a first offense, by a fine of not less than $1,000 and not more than $2,000, or by imprisonment not exceeding 10 days, or by both.
(2) 
For conviction of the second of two offenses, both of which were committed within a period of five years, by a fine of not less than $1,500 and not more than $3,000, or by imprisonment not exceeding 15 days, or by both.
(3) 
For conviction of a third or subsequent offense of a series of offenses, all of which were committed within a period of five years, by a fine of not less than $2,500 and not more than $4,000, or by imprisonment not exceeding 15 days, or by both.
C. 
The town may also institute civil action in a court of competent jurisdiction against any person determined to be in violation of any provision of Article II. If found culpable, such person shall pay a civil penalty of $1,000 or the cost, including legal and administrative expenses, associated with remedying the violation or violations and clearing away the garbage, refuse or rubbish associated with the violation, whichever is greater.
If any clause, sentence, paragraph, section or part of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in said judgment.
