As used in this article, the following terms shall have the meanings indicated:
CONSUMER FIREWORKS
Includes any combustible or explosive composition or any substance or combination of substances intended to produce visible and/or audible effects by combustion and which is suitable for use by the public that complies with the construction, performance, composition and labeling requirements promulgated by the Consumer Products Safety Commission in Title 16 of the Code of Federal Regulations (relating to commercial practices) or any successor regulation, and which complies with the provisions for consumer fireworks as defined in the American Pyrotechnics Association Standard 87-1 or any successor standard. The term fireworks does not include devices listed as ground and hand held sparkling devices, novelties, and toy caps in APA Standard 87-1, the sale, possession and use of which shall be permitted at all times in the Township.
All facilities licensed by the Pennsylvania Department of Agriculture shall comply with the following regulations as per the State Uniform Construction Code and codes referenced therein:
A. 
The facility shall be located no closer than 250 feet from any residentially occupied building.
B. 
The facility shall be located no closer than 100 feet from any street or railroad.
C. 
The facility is required to develop and maintain a written emergency plan that shall be approved annually by the Township Fire Marshal.
D. 
The facility shall provide material safety data sheets to the Township Fire Marshal annually.
E. 
Sales records shall be developed and maintained for a period of three years.
F. 
The facility shall name the Township as an additional insured on its public and product liability insurance policy in a minimum amount of $2,000,000.
G. 
A minimum of one-hour fire separation shall exist between the storage area and the internal occupancy areas.
H. 
Facilities shall not exceed one story in height and shall be without basements and no other temporary structures or trailers shall be used for storage of materials.
I. 
Storage quantities per control area are limited to 125 pounds net weight (600 pounds gross weight).
J. 
A Knox box or other secured storage container shall be provided on site for MSDS, keys, contact information and other important data.
Prior to issuance of an occupancy certificate, any facility operator shall obtain a permit from the Township for the sum of $100 annually.
Whoever violates or fails to comply with any of the provisions of this article shall be fined not more than $1,000 plus costs of prosecution and, in default of payment of said fine and costs, shall be imprisoned for not more than 30 days for each offense. A separate offense shall be deemed committed each day during which or on which a violation or noncompliance occurs or continues.
