A car wash shall be a permitted use in the B2
and LI Zoning Districts.
The necessity for certain specific uses is recognized
and at the same time appreciating the fact that it may be or become
inimical to public health, safety, and general welfare of the community,
if located without due consideration to the existing conditions and
surroundings, the following standards for a "car wash" are hereby
established:
A. The parcel upon which it shall be located shall have
a minimum frontage of 150 feet and a minimum depth of 200 feet.
B. No structure shall be erected nearer than 75 feet
to any street line, nor nearer than 50 feet to any side property line,
nor nearer than 40 feet at its rear yard line.
C. The minimum building size shall be 1,200 square feet
and shall include rest room facilities for employees and the public.
No commercial car wash shall be operated before
8:30 a.m. prevailing time and after 8:30 p.m. prevailing time from
Monday to Saturday in any week and shall not be operated on Sunday
in any week.
Any license granted or renewed hereunder may
be revoked by the Mayor and Council in the event any licensee in his
operation violates any provision of this chapter or any other applicable
ordinance of the Borough of Dumont, upon at least 10 days written
notice to the applicant at the address shown on his most recent application,
and after public hearing. Said notice shall clearly specify any and
all such violations and set the date, time and place of hearing. The
Building Inspector or other parties designated by the Mayor and Council
shall be the enforcement officer.
Any person violating any of the provisions of
this chapter shall be subject to a penalty of imprisonment in the
county jail for a term not exceeding 90 days or a fine not exceeding
$200 or both. The court before which any person is convicted for violating
this chapter shall have power to impose any fine or term of imprisonment
not exceeding the maximum fine in such ordinance.
