Whereas excessive sound or noise is a nuisance
to the public health, welfare, safety and the quality of life, it
shall be unlawful for any person, firm, partnership, corporation or
their agents or employees to commit any of the following acts in such
a manner that any noise or sound is produced that is plainly audible
across any real property boundary line or through individual dwelling
units between the hours of 11:00 p.m. through 6:00 a.m. the following
day Sunday through Friday; 11:00 p.m. Friday through 7:00 a.m. Saturday;
and 11:00 p.m. Saturday through 8:00 a.m. Sundays and legal holidays:
A. Animal. The keeping of any animal (including dogs
and cats) or bird which, by causing frequent or long continued noise,
shall disturb the comfort or repose of persons in the vicinity.
B. Construction or repairing of buildings. The erection,
including excavation, demolition, alteration or repair of any buildings
or structure.
C. Domestic power tool. The use of any domestic power
tools, including but not limited to lawn mowers, chain saws, leaf
blowers, sanders, grinders, etc., so as to disturb the quiet or repose
of anyone in the vicinity.
D. Hawker and peddler. The shouting, crying or bell ringing
of peddlers, hawkers and vendors for the purpose of attracting attention
to any performance, show, sale or display of merchandise.
E. Motorized vehicle repair. Repairing, rebuilding, modifying
or testing any motor vehicle, motorcycle or motorboat in such a manner
as to disturb the quiet or repose of any person in the vicinity.
F. Muffler or sound-dissipative device.
(1) Operating or causing to be operated any motor vehicle
or motorcycle not equipped with a muffler or other sound-dissipative
device in good working order and in constant operation.
(2) Operating or causing to be operated any motor vehicle
or motorcycle with a muffler or sound-dissipative device that has
been rendered inoperative or modified so that it produces a higher
level of noise than the standard muffler or sound-dissipative device
that is supplied for that vehicle.
G. Other loud noise. Any other loud, obnoxious or unreasonable
noise which disturbs the quiet and repose of anyone in the vicinity.
H. Radio, television set, phonograph and other device
used for sound reproduction. The use of a radio, television receiving
set, musical instrument, phonograph or other machine or device used
for the production or reproduction of sound, whether it is stationary,
portable or in a motor vehicle, which shall disturb persons in the
vicinity.
I. Yelling, shouting and similar acts. Yelling, shouting
or any other like noises at any place so as to annoy or disturb the
quiet, comfort or repose of any person in the vicinity.

Any person found in violation of any section
of this chapter shall, upon conviction, be fined as follows:
C. Third and subsequent offenses: not less than $250.
The enforcement of this chapter shall be the
duty of the Police Department of the Borough of Dumont.
