Pursuant to Connecticut General Statutes, § 8-4a, the Zoning
Commission of the City of Derby is hereby designated as the Planning and Zoning
Commission of the City of Derby with all of the powers and duties as set forth
or implied in said statutes.
The present members of the Zoning Commission shall remain as members
of the Planning and Zoning Commission until their terms expire. Upon the expiration
of each term, the Mayor, subject to the approval of the Board of Aldermen,
shall appoint a successor who shall serve for a term of five years. Each person
appointed shall be an elector of the City holding no salaried municipal office,
and not more than five members of the Planning and Zoning Commission shall
be from any one political party.
In addition to the seven regular members of the Commission appointed
pursuant to §
7-74, the Mayor of the City, with the approval of
the Board of Aldermen, shall appoint two alternates, each of whom shall be
electors of the City holding no salaried municipal office, and not more than
one of whom shall be from any one political party. The Chairman of the Planning
and Zoning Commission shall, when a regular member is unable to attend a meeting
or is otherwise unable to participate, select an alternate in place of such
member firstly from the same political party as the member, and if an alternate
from the same political party is not available, then the Chairman shall select
the second alternate. If two members are unable to attend or participate,
both alternates shall be selected, provided that the minority representation
requirements of the General Statutes are not thereby violated, in which event
the Commission shall proceed on the matter without the participation of any
alternate.
No member of the Planning and Zoning Commission shall participate in
the hearing or decision of the Commission upon any matter in which he is directly
or indirectly interested in a personal or financial sense, and shall disqualify
himself from participation in such matter. In the event of such disqualification,
such fact shall be entered on the records of the Commission, and the remaining
members of the Commission shall choose an elector of the same political party
as the disqualified member to act as a member of the Commission in the hearing
and determination of the particular matter or matters in which the disqualification
arose.
The Planning and Zoning Commission shall select from among its members
a Chairman who shall serve for a term of one year.
The City Clerk or designee shall be the Clerk of the Planning and Zoning
Commission and shall give written notice of all meetings to the Commission
members, shall cause to be published such notices as are required by the provisions
of applicable law and shall be the custodian of all official records of the
Commission. Such Clerk shall receive the compensation for such services as
may be provided by the Board of Aldermen of the City.
Except as provided previously herein, no member of the Planning and
Zoning Commission shall be removed from office during the term except for
sufficient cause, duly shown.
