Editor's Note: Former Section 18-7, Parking prohibited at all times on certain streets or parts of streets, amended 2-1-1924, 11-6-1925, 4-19-1929, 2-14-1974, 7-14-1977 and 9-8-1977, which immediately followed this section, was repealed 3-9-1995. For current provisions, see § 186-6.
[Amended 5-14-1981]
No person having the custody and/or control of a commercial vehicle or vehicles with a capacity of more than two tons shall be permitted to park on any street during the hours from 6:00 p.m. to 6:00 a.m. in the following zones: R-5, R-10, R-15, R-20, RM and P Zones, except that:
A.
Said vehicles shall be permitted to park on streets in the aforementioned zones when in the conduct of a service being simultaneously performed.
B.
Any person violating any of the above-mentioned provisions shall be fined $25 for each violation hereof.
Whenever any vehicle shall be found parked at any location where parking is prohibited or shall be found parked so as to unreasonably restrict the safe movement of fire or other emergency vehicles or so as to obstruct or hinder the operation of equipment of the City Street Department in the cleaning or maintaining of city streets or the removal of ice or snow, such vehicle may be removed or conveyed by or under the direction of a member of the Department of Police by means of towing the same or otherwise to a garage in the city, and such removal, conveyance or towing shall be at the sole risk and expense of the owner of such vehicle.
Before the owner or person in charge of such vehicle impounded pursuant to this article shall be permitted to remove the same from the custody of the Department of Police, he shall furnish evidence of his identity and ownership or right to possession, shall sign a receipt for such vehicle, for a first violation, shall pay to the clerk of the Police Department at headquarters a fee of $3, plus storage at $1 per day, and for each subsequent violation, shall pay a fee of $5, plus storage charges; provided, however, that a police officer may, in lieu of towing such vehicle to such public garage, serve upon the owner or operator of such vehicle or attach to such a vehicle a notice directing the owner or operator thereof to appear at the office of police headquarters of the city before the time specified in such notice.
When any person shall receive such notice required under § 186-9 from the Police Department to appear at the office of police headquarters of the city, such person may pay to the officer or clerk in charge thereof the sum of $1, and upon payment of such amount, a prosecution under this article shall be barred. In the event that such payment is not made within the time prescribed by the Police Department, a letter shall be written directing such person to make payment of the sum of $2 to police headquarters within a specified time. In the event that the direction contained in such letter is not complied with, the name of such person may then be referred to the prosecuting attorney for such action as may, in his opinion, be required.
In any prosecution or proceeding under this article, the registration plate displayed on the motor vehicle shall constitute in evidence a prima facie presumption that the owner of such vehicle was the person who parked such vehicle at the place where such violation occurred.
