As used in this article, the following terms shall have the meanings indicated:
PENNY ARCADE
A business establishment offering for public use three or more of any form of game, machine, instrument or apparatus operated by coin, slug or similar medium, but not including automatic machines for vending food, soft drinks or tobacco.
PERSON
Any individual, firm, partnership, corporation, organization, club or association, or any principal or agent thereof.
Penny arcades, as defined in § 3-1, are hereby prohibited anywhere within the Village of Valley Stream.
Any person committing an offense against any provision of this article shall, upon conviction, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
This article shall not operate to prohibit the maintenance of any machines as defined herein in use on the date of this enactment.
