It shall be the duty of any and all persons,
corporations or companies owning or occupying any premises in the
Village of Valley Stream, through or upon which any watercourse shall
run, to cause the channel of such watercourse to be cleared from obstructions
and to be sufficiently enlarged so as to afford free passage for the
water. Sewerage, drainage from sinks, garbage or other waste or refuse
material shall, under no circumstances, be deposited therein.
It shall also be unlawful for any person, firm,
association or corporation to dump, throw or deposit, or cause to
be dumped thereon, thrown or deposited, into any stream or natural
watercourse in the Village of Valley Stream any dirt, refuse, rubbish
or material of any kind, except with the written permission of the
Board of Trustees, signed by the Village Clerk.
Such permission shall not be granted, except
in connection with or in aid of a public improvement or under circumstances
where it can be done without impairing the quality of, impending or
diverting the flow of water, and in such cases the written permission
shall designate the place where, the time when and the conditions
under which such dumping shall be allowed.
Every violation of this chapter shall also constitute
disorderly conduct, and every person violating the same shall be a
disorderly person, subject to a fine not exceeding $50 for each and
every offense, and shall stand committed until such fine is paid,
but not exceeding one day for each dollar for such unpaid fine.
Failure to comply with this chapter will cause
the work of eliminating any and all of the conditions above referred
to as far as possible, by said Village of Valley Stream, under the
direction of the Commissioner of Public Works, and the expense thereof
shall be assessed upon the property where the violation exists and
collected pursuant to Article 5 of the Village Laws of the State of
New York.
