The owner, occupant or lessee of any lot or
parcel of land, or any part thereof, in the Incorporated Village of
Valley Stream, and any agent, servant, representative or employee
of such owner, lessee or occupant, shall keep the sidewalks or other
public thoroughfares set apart for pedestrians, adjacent to such lot
or parcel of land, free from snow, ice, dirt, filth, hedges or weeds
or other obstruction or encumbrance.
The owner, occupant or lessee of any lot or
parcel of land, or any part thereof, in the Incorporated Village of
Valley Stream shall keep the sidewalks or other public thoroughfares
set apart for pedestrians, adjacent to such lot or parcel of land,
in good and safe repair.

If any of the provisions of the foregoing sections
are not complied with, the Superintendent of Public Works may serve
written notice upon the owner, lessee, occupant or any person being
in care or control of such lot or parcel of land, or part thereof,
to comply with this article. If the person upon whom the notice is
served fails, neglects or refuses to remove the snow, ice, dirt, filth,
hedges, weeds or other obstruction or encumbrance within 24 hours
after receipt of this notice or fails, refuses or neglects to repair
such sidewalks or other public thoroughfares set apart for pedestrians
within 24 hours after receipt of the notice, the Board of Trustees
may cause such snow, ice, dirt, filth, hedges, weeds or such other
obstruction or encumbrance to be removed or may cause such sidewalks
or other public thoroughfares set apart for pedestrians to be repaired
and assess the expense thereof in conformity with the Village Law
of the State of New York upon the lot or parcel of land or part thereof
adjacent to such sidewalk or other public thoroughfare set apart for
pedestrians, and such assessment shall be added to and become and
form part of the taxes next to be assessed and shall bear interest
at the same rate as taxes and shall be collected and enforced by the
same office and in the same manner as taxes, except that the Board
of Trustees may provide, by resolution, that the cost of any such
work or improvement be paid in installments.

Any person who fails to keep such sidewalk or
other public thoroughfare set apart for pedestrians free from snow
or ice or dirt or filth or hedges or weeds or other obstruction or
encumbrance, or who fails to keep the sidewalk or other public thoroughfare
set apart for pedestrians clean and in good repair, or who shall fail
or neglect or refuse to comply with the provisions of any notice herein
provided shall be liable to a fine of not more than $1,000, and each
day such violation continues shall constitute a separate offense,
and any person violating this article or any part thereof shall be
and is hereby deemed a disorderly person. In addition to the above
stated fine, such person may be sentenced to up to 15 days in jail.
As used in this article, the following terms
shall have the meanings indicated:
Includes one or more persons of either sex, natural person,
partnership, corporation, joint-stock corporation, society and any
other entity of any kind capable of being sued.
All ordinances or parts of ordinances conflicting
with this article are repealed upon the effective date of this article.
This article shall take effect immediately.
