Every one-family dwelling, two-family dwelling
and every structure which contains three or more dwelling units, except
garden apartments, and every store or place of business where garbage
or refuse or other waste materials may accumulate shall have provided
for the use of the occupants thereof plastic bags or receptacles of
a maximum capacity of 35 gallons, with tight-fitting covers for the
top thereof, made of galvanized metal, plastic or other similar firm,
waterproof material for receiving of such garbage, refuse or other
waste material.
A sufficient number of such receptacles shall
be provided to contain the garbage, refuse or other waste material
usually accumulated between garbage collections in any dwelling, store
or place of business in the City. No such receptacle shall be filled
in such a manner as to permit the contents thereof to overflow, and
every such receptacle shall, at all times, be kept covered and protected
so as not to create a nuisance, and shall be maintained in a clean
and sanitary condition. Such receptacles shall be provided by the
lessee or occupant of a one-family dwelling, two-family dwelling,
store or other place of business and by the owner of a structure which
contains three or more dwelling units.

A. Every owner, tenant, lessee or occupant of any house,
store, building or any part thereof shall, upon the days appointed
by the proper authorities for the collection of garbage, ashes, dirt
or other household refuse, place said receptacles containing such
garbage, ashes, dirt or other household refuse upon the sidewalk area
in front of his, her or their premises, as near the curb as the same
can be conveniently placed, not earlier than 5:00 p.m. the day before
removal when Eastern Standard Time is in effect and not earlier than
6:00 p.m. when Daylight Saving Time is in effect, and shall remove
the same from the sidewalk within 12 hours after the same are emptied.

B. Prior to placing said receptacles at the curb and the removal of the same from the curb in accordance with Subsection
A hereof, said receptacles shall be placed on the side of or to the rear of the house, store or building.

Any person who violates or neglects to comply
with any provision of this article shall, upon conviction thereof,
be punished by a fine not exceeding $1,000. A separate offense shall
be deemed committed on each day during or on which a violation occurs
or continues.
The within article shall not affect §§
261-5 and
261-6 of Article
II with reference to garden apartments.
