§ 455-1 Definitions; word usage.

A. 
As used in this article, the following terms shall have the meanings indicated:
WATER SYSTEM
Any fire hydrant, gate valve or appurtenance belonging to or forming part of the publicly owned water distribution system which is operated by the Passaic Valley Water Commission, pursuant to the provisions of N.J.S.A. 40:62-108 et seq.
B. 
Number; gender. Whenever, in describing or referring to any person, matter or thing, any word importing the singular number or masculine gender is used, the same shall be understood to include and to apply to several persons as well as to one person, and to females as well as males, and to several matters and things as well as to one matter or thing.

§ 455-2 Certain actions to constitute disorderly conduct.

A person shall be guilty of disorderly conduct if he:
A. 
Shall at any time or in any manner open or operate any fire hydrant, gate valve or other appurtenance of the water system or tamper with or damage any part of the water system or destroy or cause to be removed any part of the water system.
B. 
Has in his possession or on his person any hydrant or hydrant part belonging to the Passaic Valley Water Commission.
C. 
Opens or operates, turns on, turns off, interferes with, attaches any pipe or hose to or connects anything with any fire hydrant, gate valve or other appurtenance of the water system or in any manner molests or interferes with same.

§ 455-3 Exceptions.

This article shall not be construed to apply to any duly authorized employee of the Passaic Valley Water Commission or to any duly authorized employee of the City of Clifton who shall:
A. 
Open or operate any fire hydrant, gate valve or other appurtenance of the water system or remove any part of the water system.
B. 
Have in his possession or on his person any hydrant or hydrant part belonging to the Passaic Valley Water Commission.
C. 
Turn on, turn off, attach any pipe or hose to or connect anything with any fire hydrant, gate valve or other appurtenance of the water system.
D. 
Remove any part or parts of the fire hydrant, gate valve or other appurtenance of the water system in the performance of his duties as such employee.

§ 455-4 Violations and penalties.

Any person who violates any of the provisions of this article shall be subject to a fine not exceeding $500 or by imprisonment not exceeding 90 days, or both. Each such violation shall constitute a separate offense.

§ 455-5 Rules and regulations established.

The following rules and regulations shall be established for the protection, care, regulation and control of the well water at the City Hall Complex, Clifton, New Jersey.

§ 455-6 Water to be available; limits.

Well water at the City Hall Complex premises shall be available to any Clifton resident or taxpayer, subject to whatever limit or limits the Health Officer of the City of Clifton may impose as to the amount of water that may be taken.

§ 455-7 Hours of availability.

Well water shall be available to the public seven days each week between the hours of dawn and dusk.

§ 455-8 Failure to possess or exhibit sticker to constitute violation.

Failure to have proof of residency, ownership or written authorization from a resident in one's possession, or to exhibit the same to any authorized representative or employee of the Police Department upon request, shall constitute a violation of this article.

Editor's Note: This ordinance also repealed former § 455-8, Registration fee, and § 455-9, Identification stickers to be issued. Said ordinance also redesignated former §§ 455-10 through 455-13 as §§ 455-8 through 455-11, respectively.

§ 455-9 Exceeding designated limit to constitute violation.

The taking of water in greater amount than that limited by the Health Officer as designated on the nearby sign or poster shall also constitute a violation of this article.

§ 455-10 Waiver of provisions.

The provisions of this article may be waived at the discretion of the Health Officer in the event of an emergency.

§ 455-11 Violations and penalties.

Any person who violates any provision of this article shall, upon conviction thereof, be punishable by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both.
