The office of Borough Administrator in and for the Borough of
Hillsdale is hereby created.
The Borough Administrator shall be appointed on the basis of
his or her executive and administrative qualifications. Previous responsible,
successful experience in local government and possession of a degree
in public administration and municipal management shall be preferred.

A. The Borough Administrator shall be the chief administrative officer
of the Borough, responsible to the Mayor and Council for the administration
of all Borough affairs, and with the following powers and duties:
(1) The Borough Administrator shall direct and supervise the administration
of all departments and coordinate the functions of offices, boards
and agencies of the Borough.
(2) The Borough Administrator shall prepare and submit a budget for the
calendar year to the Mayor and Council by the second week in January
or on such alternate date as set by the Mayor and Council. In preparing
the budget, the Borough Administrator shall obtain from the head of
each department, agency, board or officer, estimates of the revenues
and expenditures and other supporting data as he or she requests.
The Borough Administrator shall review such estimates and may revise
them before submitting the budget to the Mayor and Council. He or
she shall be responsible for the administration of the budget after
its adoption by the Mayor and Council.
(3) The Borough Administrator shall hire and, when necessary for the
good of the Borough, discharge any employee under his or her supervision,
provided that the Borough Administrator shall report at a prior meeting
to the Mayor and Council any action to be taken by authority of this
subsection. No person shall be discharged without just cause, and
the discharged employee shall have the right to appeal his or her
discharge to the Mayor and Council. Lesser disciplinary action may
be taken by the Borough Administrator, and he or she shall report
such action taken at the next meeting of the Mayor and Council.
(4) The Borough Administrator shall hold such other municipal offices
or head one or more of the municipal departments as the governing
body may from time to time direct.
(5) The Borough Administrator shall attend all meetings of the Mayor
and Council and its committees, with the right to take part in the
discussion.
(6) The Borough Administrator shall keep the Mayor and Council informed
as to the conduct of Borough affairs, submit periodic reports on the
condition of Borough finances and such other reports as the Mayor
and Council may request.
(7) The Borough Administrator shall be responsible for continually improving
communications among all Borough employees, departments, agencies,
boards, the Mayor and Council and the community as a whole. He or
she will constantly try to upgrade the image of the Borough of Hillsdale.
(8) The Borough Administrator shall see that terms and conditions imposed
in favor of the Borough or its inhabitants in any statute or contract
are faithfully kept and performed, and upon knowledge of any violation,
call the same to the attention of the Mayor and Council.
(9) The Borough Administrator shall continually review and supervise
the Borough's insurance program.
(10)
The Borough Administrator shall be responsible for the overall
supervision and maintenance of real property owned by the Borough
of Hillsdale.
(11)
The Borough Administrator shall act as liaison between the Borough
of Hillsdale and the various county, state and federal agencies with
respect to all applications for funds and/or services needed or required
by the Borough of Hillsdale.
(12)
The Borough Administrator shall review daily any complaints
concerning the functions and obligations of the Borough of Hillsdale
made by any of its residents, and he or she shall have a permanent
record of complaints and the disposition made.
(13)
The Borough Administrator shall participate in the negotiation
of all collective bargaining agreements for the Borough of Hillsdale.
(14)
The Borough Administrator shall prepare the work session agenda.
(15)
The Borough Administrator shall establish and maintain effective
personnel practices and maintain appropriate records of all employees.
(16)
The Borough Administrator shall delegate to any department head
such of his or her powers as he or she may deem necessary for efficient
administration.
(17)
The Borough Administrator shall implement and enforce the policy
of the Mayor and Council with respect to the compiling and release
of public information.
(18)
The Borough Administrator shall perform such other duties as
may be assigned to him or her from time to time by the Mayor and Council.
(19)
A Borough Administrator shall perform the duties of the appropriate
authority as that position is described pursuant to N.J.S.A. 40A-14-118.

B. Except for the purpose of inquiry, the Mayor and Council and its
committees shall deal with the administrative service solely through
the Borough Administrator, and neither the Mayor and Council nor any
of its committees shall give orders, publicly or privately, to any
subordinates of the Borough Administrator.
