A Municipal Court is hereby established under Chapter 8A of Title 2 of the Revised Statutes of New Jersey, as amended and supplemented.[1] The name of said Court shall be the "Municipal Court of the Borough of Kinnelon."

Said Municipal Court shall have and exercise the limited civil and criminal jurisdiction prescribed by said Chapter 8A of Title 2 of the Revised Statutes of New Jersey, as amended and supplemented from time to time.[1]

Said Court shall have a Judge, who shall be known as the Judge of the Municipal Court. He shall be appointed by the Mayor, with the advice and consent of the Council, on January 1 for a term of three years, and shall possess the qualifications as set forth in said Chapter 8A of Title 2 of the Revised Statutes.[1]

The Borough Council may by ordinance or resolution provide for a Clerk and other necessary clerical and other assistants for said Municipal Court.
The compensation of the Judge of the Municipal Court shall be established by ordinance and shall be in lieu of any and all fees. The compensation of the Clerk and clerical and other assistants may be established by ordinance or resolution.

Any person entitled by law to appointment of counsel may apply to the Municipal Court for representation by a Municipal Public Defender in an action pending before said Court. Such application shall be accompanied by an application fee in the amount of $200. Upon request of the applicant, the Municipal Court may waive said application fee, in whole or in part, if the Court determined, in its discretion, that the application fee represents an unreasonable burden on the person seeking representation. Funds collected from the application fee shall be deposited in a designated fund administered by the chief financial office of the Borough. The funds shall be used exclusively to meet the cost incurred in providing the services of a Municipal Public Defender, including, when required, pursuant to P.L. 1997, c. 256,[1] expert and lay investigation and testimony.
