No land area shall be disturbed by any person, partnership, corporation, municipal corporation or other public agency within this municipality unless the applicant has submitted to the Construction Official a plan to provide for soil erosion and sediment control for such land area in accordance with the Standards for Erosion and Sediment Control promulgated by the New Jersey State Soil Conservation Committee and such plan has been approved and a valid land disturbance permit has been issued by the Construction Official, except as exempted by Article IX.
The Construction Official shall grant approval or denial of the plan, in writing, within a period of 30 days of submission of a complete application, unless, by mutual agreement in writing, this period is extended for an additional 30 days. A copy of the decision and other pertinent data shall be sent to the Morris County Soil Conservation District. Failure of the Construction Official to make a decision within the aforementioned time period or such extension thereof shall constitute approval. The applicant shall be provided with a written notice of such decision by the Construction Official or other authorized municipal agent. A copy of such decision, including the name of the applicant, site location by street address and block and lot number and proposed land use, shall be sent to the Morris County Soil Conservation District. The Borough shall also make available such other information as may be required by the District.
A. 
The applicant shall submit a separate soil erosion and sediment control plan for each noncontiguous site. Such plan shall contain:
(1) 
A map of the site, at an appropriate scale not less than one inch equals 100 feet, showing existing contour lines at two-foot intervals. A map showing general topography may be substituted at the discretion of the Construction Official.
(2) 
The location and description of existing natural and man-made features on and surrounding the site, including soil characteristics. Applications encompassing an area greater than three acres shall include a copy of the appropriate part of the United States Department of Agriculture Soil Survey.
(3) 
Location and description of proposed changes to the site.
(4) 
Measures for soil erosion and sediment control, both temporary and permanent which meet or exceed the Standards for Soil Erosion and Sediment Control promulgated by the State Soil Conservation Committee. These standards shall be on file at the offices of the Morris County Soil Conservation District and the Borough Clerk.
(5) 
A schedule of the sequence of installation of planned erosion and sediment control measures as related to the progress of the project, including anticipated starting and completion dates for control measures and for each step in the land disturbance and development sequence.
B. 
All proposed revisions shall be submitted for approval.
Soil erosion and sediment control plans shall be reviewed by the Borough Engineer and approved when in conformance with the Standards for Erosion and Sediment Control. The Borough Engineer may seek the assistance of the Morris County Soil Conservation District in the review of such plans and may deem as approved those plans which have been reviewed and determined adequate by said District.
