§ 37-1 Board of Recreation and Parks established.

The County Commissioners of Dorchester County are hereby authorized and empowered to establish a Board of Recreation and Parks for Dorchester County, hereinafter referred to as the "Board," with the powers and duties specified in this chapter.

§ 37-2 Membership, organization and rules of procedure.

A. 
Composition; terms; vacancies; compensation. The Board shall consist of ten (10) members appointed by the Board of County Commissioners of Dorchester County, Maryland, all of whom shall have been legal residents of Dorchester County, Maryland, for a period of three (3) years next preceding their appointment and one (1) of whom shall be the Superintendent of County Schools or his designated representative. All members of the Board shall be appointed for terms of four (4) years from the first day of January of the year of their appointment or until their successors are appointed. The present Directors of the Cambridge-Dorchester Recreation League, Inc., shall compose the Board for the first term of four (4) years. Vacancies occurring otherwise than by expiration of a term shall be filled in the same manner as the original appointments and for the unexpired term. In the appointment of members of the Board by the County Commissioners of Dorchester County, due regard shall be given to the population and the character of development in the various sections or areas of the county. All members of the Board shall serve without compensation, except for necessary expenses.

B. 
Officers; meetings. The Board shall annually select from among its membership a Chairman, a Vice Chairman and a Treasurer. The Board may require the latter to give such bond in such amount as it may determine. Its Secretary may or may not be a member of the Board. The Board is hereby empowered to adopt all necessary rules and regulations for the conduct of its business and shall hold such meetings, both regular and special, as may from time to time be deemed necessary. The Board shall hold at least four (4) meetings yearly. The Board's regular place of business shall be Cambridge, Dorchester County, Maryland, but both regular and special meetings of the Board may be held elsewhere in the discretion of the Board.

§ 37-3 Appointment of Director; term; qualifications.

The County Commissioners may appoint a Director of Recreation and Parks. The Director shall be the Chief Executive Officer of the Board but not a member of the Board. With the advice of the Board, the Director shall be charged with the general organization, administration and supervision of the programs of public recreation contemplated and provided for by this chapter. The Director shall serve at the pleasure of the County Commissioners. The Director shall have such training, experience and capacity as will especially qualify the Director to discharge the duties of the office and those qualifications of education, training and experience which will assure a thorough knowledge of current theory and practice in public recreation. The Director shall give promise of the administrative ability to initiate and maintain a program within the jurisdiction and under the direction of the Board.

§ 37-4 Powers and duties of Board.

A. 
Determination of general policy; expenditure of funds. The Board is authorized and empowered to consider and determine all questions of general policy relating to public recreation and parks for Dorchester County and shall supervise and direct expenditure of all appropriations and funds made available to the Board from whatever source. The Board shall have power to appoint from time to time such advisory committee or panels as it may see fit in the furtherance of its powers and functions herein granted.
B. 
Comprehensive recreation programs; maintenance and operation of facilities; permits. The Board shall have power and authority to initiate, adopt, direct or cause to be conducted or directed under its supervision a comprehensive program of public recreation in schools, parks or other lands or buildings, either publicly or privately owned, or other acceptable recreational facilities made available to the Board for such purposes by the County Commissioners of Dorchester County or by any other person, corporation or agency having jurisdiction over such facilities. The Board is further authorized to develop, equip, operate and maintain and issue permits for use of any of the facilities made available to and accepted by the Board for such purposes by the County Commissioners of Dorchester County or by any person, corporation or agency having jurisdiction over such facilities, and the County Commissioners of Dorchester County may transfer to the Board created hereunder functions now performed by other organizations which may be properly performable by the Board. The control of any land, buildings or other acceptable facilities made available to the Board shall be in accord with agreements reached between the Board and the person, corporation or agency having jurisdiction over such properties.
C. 
Construal of authority conferred. No power or authority conferred by this chapter shall be construed to abridge or limit the power of the County Commissioners of Dorchester County or of any governmental agency or of any person or corporation to refuse to permit or to limit the use of any ground, building or facility under their individual or collective control for recreational purposes. For the purpose of carrying on its functions, the Board may act directly or through a duly designated agent, agents or agencies.

§ 37-5 Employment of other personnel.

The County may, within the limits of funds appropriated by the County Commissioners, employ such personnel, in addition to the Director of Recreation and Parks, as the Board recommends as necessary to administer its functions properly. The Director and all other personnel of the Board shall be employees of Dorchester County. Their salaries shall be set by the County Commissioners. The county also may employ personnel on a part-time or temporary basis and may discharge any person employed by it. The engagement of voluntary workers without compensation may also be undertaken by the county upon the recommendation of the Director.

§ 37-6 Submission of annual report and budget; restrictions on transferring allocated funds.

The Board shall submit to the County Commissioners of Dorchester County an annual report of its activities, together with recommendations for further activities and development of the county recreation and parks program, and shall also submit an annual budget, itemizing the appropriations necessary for the performance of its functions and duties in carrying out its program under this chapter; however, no moneys allocated to the Board under this budget shall be transferred to activities or programs not provided for in said budget without the consent and approval of the Board of County Commissioners of Dorchester County.

§ 37-7 Gifts and bequests; buildings and facilities.

A. 
Acceptance of gifts and bequests; public funds. The County Commissioners of Dorchester County, by and through the Board of Recreation and Parks hereby created, shall have power to accept any grant, devise or lease of real estate or any gift or bequest of money or other property or any donations to be applied, principal or income or both, for either temporary or permanent use to parks, playgrounds or other recreational purposes. This power shall include authority to take advantage of any public funds which might become available for recreational projects.
B. 
Conditions; intergovernmental cooperation. If any such grant, devise, lease, gift or bequest is conditional, the proper authorities of the county shall have power to accept the same upon the conditions attached and to comply with such conditions if, in the judgment of such authorities, such conditions are reasonable and for the best interests of the county. Money received in any such manner, unless otherwise provided by the terms of the gift or bequest, shall accrue and become a part of the funds available for expenditure by the Board for recreational and parks purposes as herein defined. The County Commissioners of Dorchester County may, by and through the Board of Recreation and Parks hereby created, join or cooperate with the federal government or the State of Maryland or with one (1) or more municipalities or with one (1) or more Dorchester County community recreation councils or with one (1) or more other counties or with the Dorchester County Board of Education or the Board of Recreation and Parks of one (1) or more municipalities or of one (1) or more other counties in providing, establishing and conducting recreation centers, playgrounds, parks and other recreation facilities and activities.
C. 
Purchase and/or improvement of buildings and facilities. The Board shall have the power to purchase, construct or improve buildings and facilities.
