A.
Property owners desiring the installation of tidegates
or floodgates on pipes that have been installed by the County Roads
Board in either entrance pipes or outlet ditch pipes shall first obtain
the approval of the County Roads Board.
B.
This approval shall not be arbitrarily withheld but
is necessary to determine that sizing and other design considerations
are acceptable and that the drainage pattern will not be adversely
affected.
A.
All costs will be at the property owner's expense.
Installation shall be by private contractor or other than County Roads
Board forces and acceptable to the County Roads Board.
B.
If the installation of a tidegate necessitates the
replacement or modification of an existing pipe which is performing
adequately, these replacement or modification costs are to be the
property owner's expense.
C.
All maintenance costs involved in the proper operation
of the tidegate are to be the responsibility of the property owner.
If the tidegate is not properly maintained by
the property owner and drainage problems are created, the county may
correct the problem and bill the property owner or remove the tidegate
from the pipe at the property owner's expense.
If necessary, because of change in land use
or change in drainage patterns caused by the property owner and/or
deterioration of the tidegate. the County Roads Board shall have no
obligation to replace the tidegate.
