GENERAL REFERENCES
Carnivals and circuses — See Ch. 117.
As used in this chapter, the following terms shall have the meanings
indicated:
Any procession or moving assemblage upon any street or public thoroughfare,
other than routine vehicular traffic or a funeral procession.
Permits shall be required upon the following conditions:
A.
No person or organization shall engage and participate
in, aid, form, or conduct any street parade without first obtaining a permit
from the Borough.
A.
A person or organization seeking a parade permit shall
file an application with the Borough Manager not more than 180 days prior
to the date of the event.
B.
Parade permit applications shall be approved by the Borough
of Waynesboro.
C.
Groups requesting parades or walks along public rights-of-way
way shall obtain the advice of the Police Department of the Borough of Waynesboro
as to the safety, route and potential traffic control problems, and shall
utilize same insofar as practicable in their request.
D.
Groups wishing to occupy or use state highways will be
responsible to obtain all required PennDOT or other necessary permits.
E.
Representatives of the state, county or local law enforcement
services, veterans' organizations or entities involved in the national
defense may display or carry weapons upon approval by Borough Council.
F.
The proposal shall include a program for cleanup of the
parade route by the group. The group should outline its procedures and methods
for cleaning up the parade route.
G.
The proposal shall note arrangements which have been
made regarding policing, supervision and public safety. Arrangements must
be approved by the Chief of Police and, if necessary, the Fire Chief.
Council will consider all ramifications to the public prior to permitting
or denying the requests, or shall place added conditions as they deem necessary.
A.
Standards for issuance of permits. The Borough Council
of Waynesboro shall issue a permit as provided for hereunder, from consideration
of the application and from such other information as otherwise may be obtained,
provided the following:
(1)
The conducting of the parade will not substantially interrupt
the safe and orderly movement of other traffic contiguous to its route.
(2)
The conducting of the parade will not require the diversion
of so great a number of police officers of the Borough to properly police
the line of movement in the areas contiguous thereto, as to prevent adequate
protection to the Borough.
(3)
The conducting of the parade will not require the diversion
of so great a number of ambulances as to prevent adequate ambulance service
to portions of the Borough other than that to be occupied by the proposed
line of marching and areas contiguous thereto.
(4)
The concentration of persons, animals and vehicles at
assembly points of the parade will not unduly interfere with proper fire and
police protection of, or ambulance services to, areas contiguous to such assembly
areas.
(5)
The conducting of such parade will not interfere with
the movement of fire fighting equipment enroute to a fire.
(6)
The conducting of the parade is not reasonably likely
to cause injury to persons or property, to provoke disorderly conduct, or
create a disturbance. Demonstrated past conduct shall be considered in evaluating
this criteria.
(7)
The parade is scheduled to move from its point of origin
to its point of termination expeditiously and without unreasonable delays
enroute.
(8)
The parade is not designed to be held primarily for private
profit.
B.
Time limit on decision. The Borough of Waynesboro shall
act upon the application for parade permit within 45 days after the filing
thereof. If the Borough of Waynesboro disapproves the application, a notice
shall be mailed within 10 days of the denial.
C.
Appeals. Any person aggrieved shall have the right to
appeal the denial of a parade permit to the Borough Council. An appeal shall
be taken within five days after the notice, and Council shall act upon the
appeal at the next scheduled Council meeting.
Any person violating this chapter shall be guilty of a summary offense
and shall, upon conviction, be sentenced to pay a fine of not less than $100
nor more than $300, plus costs of prosecution.
