On and after the effective date of this Article, approval of the Highway Superintendent shall be required before any person, firm or corporation shall:
A. 
Move, alter or disturb any existing drainage ditch or culvert upon any public highway which the Town is obligated to maintain or which drains such highway; and
B. 
Install or change any driveway connecting with or draining upon such highway.

The Highway Superintendent may require the person, firm or corporation to whom approval is granted under § 130-1 hereof to post a performance bond or other security acceptable to the Town of Tolland to guarantee the proper functioning of the installation or change of said facility.

Any person, firm or corporation who violates any provision of this Article shall be fined not more than $90. Each day of violation thereof shall be deemed a separate offense.
