(a)
There shall be a Department of Public Works managed
and supervised by the Public Works Commission. The day to day operation
of the department shall be vested in a superintendent or director
who shall report to and be directed and supervised by the commission.
The Public Works Commission shall by regulation prescribe the duties
of the Department of Public Works and the superintendent or director
with respect to the construction and maintenance of Town buildings
and structures, highways and sidewalks, sewers and drains, care of
trees and grounds, the collection and disposal of garbage and rubbish,
and the maintenance of apparatus and equipment used by the Department.
(b)
The Department of Public Works may undertake such
maintenance and care of school buildings and grounds as requested
by the Board of Education, approved by the Public Works Commission,
and charged to Board of Education appropriations.
(c)
The Department of Public Works may undertake maintenance
and care of beaches and parks if the Public Works Commission so directs
on request of the Parks and Recreation Commission.
(a)
The Board of Police Commissioners shall organize,
maintain, and have the general management and control of the Police
Department and its apparatus and equipment. It shall have the powers
and duties prescribed by the Connecticut General Statutes for boards
of police commissioners. It shall make all needful regulations for
the government of the Police Department not contrary to law and may
prescribe suitable penalties for the violation of any such regulation,
including suspension (either by the Board or by the Chief of Police)
or removal from office of any officer or member of the Police Department.

(b)
The Board shall have the sole power of appointment,
promotion and removal of the officers and members of the Police Department,
both regular and supernumerary, under such regulations as it adopts
for the purpose, and such appointees shall hold office during good
behavior and until removed for cause upon written charges and after
hearing.
(c)
The members of the Police Department shall have all
the authority with respect to the service of criminal process and
the enforcement of the criminal laws that is vested by the Connecticut
General Statutes in police officers.

(d)
The Board shall appoint a Chief of Police, who shall
be the chief administrative officer of the department and shall be
responsible to the Board for the efficiency, discipline, and good
conduct of the department. Removal from the department, or reduction
in rank, of the Chief of Police shall be effected in accordance with
the Connecticut General Statutes.

(e)
There shall be such other officers of the department
as the Board shall appoint. These officers may be reduced in rank
for cause upon written charges and after a hearing.
(a)
The Board of Fire Commissioners shall maintain and
be responsible for the management of the Fire Department and shall
further be responsible for the maintenance and care of all apparatus
and equipment owned by the town and used by the Fire Department. The
Board of Fire Commissioners shall make regulations for the conduct
of the Fire Department and shall set standards and specifications
which shall be followed in the purchase by the town of apparatus,
equipment and supplies for the Fire Department.
(b)
The Board of Fire Commissioners shall appoint a Fire
Chief and an Assistant Chief of Operations. The Board of Fire Commissioners
shall have the authority to determine whether the appointive positions
of Fire Chief and of Fire Marshal shall be filled at the same time
by one or two persons. A volunteer Assistant Chief and other necessary
officers of the volunteer Fire Department shall be elected at volunteer
Fire Department meetings to serve terms of three years.

(c)
The Board of Fire Commissioners shall appoint Fire
Police Officers and a Fire Marshal, and may appoint Deputy Fire Marshals,
all of whom shall have the powers and duties prescribed by the general
statutes of the state of Connecticut.

(d)
So long as the Board of Fire Commissioners is satisfied
that adequate fire protection is being provided to the town by its
volunteer fire companies then the volunteer fire companies of Guilford
as they are presently constituted and as they may hereafter from time
to time be constituted, shall be the Fire Department of the town,
and the Board of Fire Commissioners shall arrange with the volunteer
fire companies of the town for the protection thereof from fire on
such conditions as to financial assistance and otherwise as the Board
of Fire Commissioners deem to be in the best interests of the town.
(e)
At any time that the Board of Fire Commissioners deems
it necessary in order that adequate fire protection continue to be
provided to the town, it may, if there is an appropriation available,
employ persons as additional members of the Fire Department to serve
as firefighters to assist, aid and supplement the services of the
existing volunteer fire companies. The hiring, promotion, removal
and conduct of such firefighters shall be in accordance with regulations
adopted by the Board of Fire Commissioners, provided however that
an employed firefighter, shall hold office during good behavior and
until removed for cause by the Board of Fire Commissioners upon written
charges presented to the firefighter and heard by the Board of Fire
Commissioners not sooner than forty-eight hours after the presentation
of said written charges to the firefighter concerned. The Board of
Fire Commissioners shall from time to time delegate to the Fire Chief
such authority as is necessary for the effective supervision of hired
firefighters.

(f)
The organization, government and membership of the
volunteer fire companies of the town shall be in accordance with the
by-laws of such companies in effect on the effective date of this
provision and as thereafter amended from time to time by the volunteer
fire companies to the extent that said by-laws are not inconsistent
with the provisions of this charter or of the Connecticut General
Statutes of the state of Connecticut.

The Board of Selectmen may, subject to necessary
appropriations, establish and maintain other departments and agencies
for the administration of town functions.
The Board of Selectmen shall appoint town counsel
to furnish such legal services to the town and its agencies as the
Board may authorize.
(a)
There shall be full-time offices of Assessor, Tax
Collector, Town Clerk and Fiscal Officer.
(b)
Each of these officials, after a probationary period
of three years, shall hold office during good behavior, and may be
removed only for cause after charges in writing and a hearing before
the appointing authority.
(c)
Whenever one of these offices is vacated, the Board
of Selectmen shall appoint a successor on the basis of a competitive
or other examination deemed appropriate by the Board of Selectmen.

The Board of Selectmen shall appoint a Health
Director for a term of four years, with the powers and duties of Health
Directors prescribed by the Connecticut General Statutes.

(a)
The Board of Selectmen may hire, suspend and dismiss
employees of the town, except employees of the Board of Education
and employees whose employment and removal is otherwise provided for
by the Connecticut General Statutes or this charter. The Board of
Selectmen may by regulation delegate this power to the First Selectman,
or to other agencies of the town with respect to employees in such
agencies.

(b)
Uniform procedures for the recruitment and removal of any class of employees other than those excepted in Section 5-9(a), or a general merit system for employees of the town may be established by ordinance.
(c)
The Board of Selectmen may by regulation establish
the working hours and wage or salary scales of any class of employees
other than those excepted in Subsection 5-9(a).
(d)
A retirement system for employees of the town may
be established by ordinance.
