There be and is hereby created, in the Town
of Guilford, a Marina Commission, the members of which shall be appointed
by the Board of Selectmen. The Commission shall consist of five members
and two alternates, who must be electors of the Town. Insofar as practicable,
members appointed shall be representative of all groups interested
in the operations of the Marina. No more than three shall be from
one political party. Alternate members shall, when seated, have all
the powers and duties of a member of the Commission.
Initially, the Board of Selectmen shall appoint
one member to the Commission to serve for a term of one year, two
members to serve for a term of two years and two to serve for a term
of three years or until a successor is appointed and qualified. Thereafter,
all appointments shall be for a term of four years or until a successor
is appointed and qualified. Vacancies shall be filled for the unexpired
term by the Board of Selectmen. Members of the Commission shall serve
without pay.
Annually, immediately after the regular appointment
of a new member or members, the members of the Commission shall meet
and elect a Chairperson and such other officers as may be necessary.
The Commission shall hold regular meetings and
shall designate the time and place thereof and shall have the power
to adopt rules and regulations for the conduct of business within
its jurisdiction and shall keep a record of all its proceedings. Three
members shall constitute a quorum. When a member shall fail to be
present at four consecutive meetings or at 1/4 of the meetings held
in any fiscal year, his or her membership shall be vacant, unless
his or her absence shall be excused by the Commission and the reason
thereof entered into the record of the Commission's proceedings.

The powers and duties of the Marina Commission
shall be exercised and performed as herein provided and in conformity
with the town ordinances.
A. The Marina Commission shall be charged with the control,
development, management, operation and maintenance of the Town Marina
and, in connection with such duties, shall have the power to expend
funds appropriated by the town, generated through revenue-producing
activities of the Commission or donated or bequeathed by private individuals
or organizations for such purposes.
B. The Commission shall have the power to set and collect
fees for the use of the Marina or its facilities, to make and enforce
regulations appertaining thereto, to hire personnel in connection
with the operation of the Marina and to do such other acts and things
as may be necessary or convenient in the operation of the Marina.
C. The Commission shall have the power to call upon any
other department of the town government for assistance in the performance
of its duties and to cooperate with any other department of the town
government in projects of mutual interest.
The Commission, at the regularly designated
time, shall submit an estimate of anticipated expenditures for the
coming fiscal year. The Commission shall operate within the budget
as approved.
The Commission shall, from time to time, but
not less often than annually, make a report to the Town Meeting relative
to the work of the Commission and shall submit such other reports
as may be requested from time to time.
