A. 
The Board of Trustees of the Village of Belle Terre may appoint a Planning Board consisting of six members. Five members shall serve as regular members of the Board as provided for in Village Law. The sixth member shall serve as an alternate member of the Board and shall be called upon to serve when, and if, any other member is unavailable, for any reason, to hear an application. Members of such Board shall be appointed for terms of five years.
B. 
The Chairperson of the Planning Board may designate an alternate member to substitute for a regular member for any application, matter or period of time such member is absent or unable to participate on an application or matter before the Board. Such designation shall be entered into the minutes of the Planning Board meeting at which the substitution is made.
C. 
An alternate member of the Planning Board shall serve for the same term as a regular member of the Board and have the same obligations, powers and duties as a regular member of the Board. Any decision or determination of the Board which includes the vote of an alternate member shall have the same force and effect as decisions or determinations made solely by a vote of the regular members of the Board.

The Board of Trustees shall designate a member of said Planning Board to act as Chairman thereof, or on failure so to do, the Planning Board shall elect a Chairman from its own members.
B. 
The designated Chairman of the Planning Board is elected for a one-year term only.
The Planning Board may adopt rules and regulations in respect to procedure before it and in respect to any subject matter over which it has jurisdiction under this Article or any other statute, after public hearing by the Planning Board and subject to the approval of the Board of Trustees.
The Board of Trustees may authorize the Planning Board to review and approve, approve with modifications or disapprove site plans, prepared to specifications set forth in the regulations of the Planning Board, showing the arrangement, layout and design of the proposed use of the land shown on such plan.
The application and fee for a subdivision shall be submitted to the Village Clerk and be in accordance with Chapter A175, Subdivision of Land.
Any person aggrieved by any decision of the Planning Board may apply to the Supreme Court for review by a proceeding under Article 78 of the Civil Practice Law and Rules (CPLR).
