No person shall have, possess, carry or transport liquor, wine, beer or other alcoholic beverages in or upon any public sidewalk, street, highway, parking lot or public park in the Village of Saranac Lake in open containers, and no person shall drink or otherwise consume liquor, wine, beer or other alcoholic beverages in or upon any public sidewalk, street, highway, parking lot or public park in the Village of Saranac Lake.
A. 
If any organization desires to dispense alcoholic beverages on public property in the Village of Saranac Lake, it must apply to the Saranac Lake Village Board of Trustees for permission to do so not less than 15 days prior to the date that it desires to dispense said beverage. No fee shall be charged for the granting of this permission, and said permission, if granted, shall be contingent upon said organization securing a proper license from the appropriate Alcoholic Beverage Control Board to dispense alcoholic beverages on the said property. This license shall be displayed to the Village Manager.
B. 
No alcoholic beverage shall be consumed other than on those premises described in the letter of permission issued by the Village.
An open bottle or open container in which there is an alcoholic beverage in any vehicle shall be presumptive evidence that the same is in possession of all occupants thereof and in violation hereof.
The violation of any of the provisions of this chapter shall be punishable by a fine of not less than $5, nor more than $250, and, in addition to said penalty, a violation of any provision of this chapter shall constitute disorderly conduct, and any person violating the same shall be a disorderly person and shall be subject to arrest, prosecution and punishment, as provided in § 338 of the Village Law.[1]
