A. 
Title. This chapter shall be known as the "Peace and the Good Order Law of the Village of Saranac Lake."
B. 
Policy. It is hereby declared to be the policy of the Village of Saranac Lake to prevent unreasonable noise which disturbs the peace, quiet, comfort and order of a neighborhood or the public, as well as to prevent conduct which adversely affects the public health, safety and welfare of the Village. It is further declared that the provisions and prohibitions hereinafter contained and enacted are in pursuance of and for the purpose of preserving, protecting and promoting the public health, safety, welfare, comfort, convenience, peace, quiet and order of the Village of Saranac Lake and its inhabitants.
C. 
Definitions. As used in this chapter, the following terms shall mean:
AUTHORIZED EMERGENCY VEHICLE
Every ambulance, police vehicle, fire vehicle, civil defense emergency vehicle and emergency ambulance service vehicle defined in Article 1 of the Vehicle and Traffic Law of the State of New York.
COMMERCIAL OPERATION
Any business or commercial activity that involves the purchase, sale or utilization of goods or services to the public, including, but not limited to, commercial drinking and dining establishments, motor vehicle services, retail and wholesale services, banks and office buildings, recreation and entertainment facilities, community services and public services.
DEVICE
Any machine, mechanism, instrument or equipment which is intended to or which actually produces, transmits, receives, reproduces or retransmits sound or vibration, television signals or radio signals.
EMERGENCY OPERATION
The operation or parking of an authorized emergency vehicle when such vehicle is engaged in transporting a sick or injured person, pursuing an actual or suspected violator of the law or responding to or working or assisting at the scene of an accident, disaster, police call, alarm of fire or other emergency. "Emergency operation" shall not include return from such service.
MOTORBOAT
Any vessel which operates on the water and which is propelled by a motor, including, but not limited to, boats, barges, amphibious crafts, water-ski towing vessels and jet skis.
MOTOR VEHICLE
Every vehicle operated or driven upon a public highway which is propelled by any power other than muscular power, except:
(1) 
Electrically driven invalid chairs being operated or driven by an invalid; and
(2) 
Vehicles which run only upon rails or tracks.
OFF-ROAD RECREATIONAL VEHICLE
Any vehicle which is propelled by any power other than muscular power that is designed for or capable of cross-country travel, such as a motorcycle, trail bike, minibike and snowmobile.
OWNER
Any person who has regular control of a device or site, including, but not limited to, the owner of the freehold of the premises or a lesser estate therein, or mortgagee thereof, or an agent or employee of such person.
PERSON
Any individual, partnership, company, public or private corporation, association, firm, organization, group of individuals, or any other legal entity whatsoever.
PLACE OF PRIVATE RESORT
Any residence or any place of any description which is not a place of public resort.
PLACE OF PUBLIC RESORT
Any commercial operation or any place of any description where the broad class of persons who constitute the public:
(1) 
Has a right to go for frequent assemblies; or
(2) 
Is invited or permitted to go either without charge or upon payment of a fee.
RESIDENCE
Any apartment, condominium, cooperative apartment, townhouse, home, house or dwelling which is used by any person for living quarters.
SOUND-REPRODUCTION DEVICE
Any device that is designed to be used or is actually used for the production or reproduction of sound, including, but not limited to, any musical instrument, radio, television, tape recorder, phonograph or any other sound-amplifying device.
SOUND-SIGNAL DEVICE
Any device that is designed to be used or is actually used to produce a sound signal, but not spoken language, including, but not limited to, any claxon, horn, whistle, bell, gong, siren, rattle, clapper, hammer, drum or air horn.
TOBACCO
The term "tobacco" shall include any product that contains tobacco, including, but not limited to, cigarettes, cigars, pipes, chew, snuff, as well as any form of smokeless tobacco.

UNREASONABLE NOISE
Any excessive or loud sound which disturbs, injures or endangers the peace, comfort, order, repose or health of a neighborhood or the public.
ZONING DISTRICT
The same meaning as provided in Chapter 106 of the Code of the Village of Saranac Lake.
A. 
It shall be unlawful for any person to:
(1) 
Make, or cause or permit to be made, any unreasonable noise;
(2) 
Knowingly operate or keep any place of public resort or place of private resort where unreasonable noise is made or is caused or permitted to be made; or
(3) 
Operate or permit to be operated any sound-reproduction device or sound-signal device at a place of public resort or at a place of private resort after the hour prescribed as the legal closing time in the county where such premises are located, provided that such person:
(a) 
Owns or holds a license issued pursuant to the Alcoholic Beverage Control Law of the State of New York; and
(b) 
Owns or operates any hotel, restaurant, tavern, bar, grill or cocktail lounge on such premises.
B. 
Upon the trial of any complaint alleging a violation of Subsection A(1) and (2) of this section, the court shall consider at least the following:
(1) 
The intensity of the noise.
(2) 
The proximity of the complaining person or persons, at the time of the alleged violation, to the premises of the person allegedly in violation.
(3) 
The nature and the zoning district of the area within which the violation allegedly occurred.
(4) 
The time of day or night the violation allegedly occurred.
(5) 
The time duration of the sound allegedly constituting the violation.
A. 
No person shall knowingly or wantonly operate or cause to be operated any machine, device or instrument of any kind whatsoever within the corporate limits of the Village of Saranac Lake between the hours of 9:00 a.m. and 12:00 midnight, the operation of which shall cause reasonably preventable electrical interference with radio and/or television reception within said municipal limits; provided, however, that X-ray pictures, examination or treatments may be made at any time if the machines or apparatus used therefor are properly equipped to avoid all unnecessary or reasonably preventable interference with the radio and television reception and are not negligently operated.
B. 
This section shall not be held or construed to embrace or cover the regulation of any transmitting, broadcasting or receiving instruments, apparatus or devices used or useful in interstate commerce or the operation of which instrument, apparatus or device is licensed or authorized by or under the provisions of any act of the Congress of the United States or the Legislature of the State of New York.
C. 
A duly authorized electrical inspector appointed by the Board of Trustees shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the installation and working of all devices coming within the terms of this chapter, and it shall be unlawful for any person to interfere with the inspector in making said inspections or to refuse to permit him or them to enter the premises for such purposes.
D. 
Each day during which any violation under this section continues shall constitute a separate violation hereunder.
No person shall willfully or maliciously mutilate, break, mar, injure remove or deface any building, fence, awning, wall, sign, tree, shrubbery, sidewalk, street, monument, bench, window, motor vehicle or any other item of real or personal property in the Village.

No person shall throw, discharge or dump any litter, refuse or waste, including, but not limited to, garbage, refuse, industrial and commercial waste, rubbish, tires, ashes, incinerator residue, construction and demolition debris, discarded automobiles or offal, in or upon any street, sidewalk, public property or private property within the corporate limits of the Village of Saranac Lake or Lake Flower or the Saranac River within such corporate limits except as otherwise permitted at a sanitary landfill which has been designated by law or by a resolution of the Board of Trustees.
No person shall harbor, own, keep or permit a dog or dogs that howl or bark incessantly within the limits of the Village which disturb the peace, quiet and order of any neighborhood or the public within the Village.
A. 
No person shall stick, post or in any way attach any card, bill or advertisement upon any of the public buildings or structures in the Village or upon any building, structure, tree, telephone pole, power transmission pole or electric light pole in the Village without the written consent of the owner or owners thereof.
B. 
It shall be unlawful for any person to tear down, deface or destroy any notice, handbill or advertisement lawfully posted.

A. 
It shall be unlawful for any person to expectorate upon the sidewalks or streets of the Village or upon any doorstep or stairway adjacent to the sidewalks and streets.
B. 
It shall be unlawful for any person to spit tobacco or tobacco juice upon the ground in any public playground or park owned, maintained or operated by the Village of Saranac Lake.
A. 
It shall be unlawful for any person to operate or permit to be operated any motor vehicle or off-road recreational vehicle in such a manner as to make or cause to be made any unreasonable noise.
B. 
Upon the trial of any complaint alleging a violation of Subsection A of this section, the court shall consider the same facts and circumstances set forth in § 188-2B of this chapter.

A. 
Smoking is prohibited in the following Village of Saranac Lake parks at all times:
(1) 
William Morris Park.
(2) 
Ampersand Park.
(3) 
Skate Park.
B. 
Smoking is prohibited at Lake Colby Beach during normal summer beach operations when lifeguards are on duty
C. 
Smoking is prohibited at Mt. Pisgah Ski Center during normal winter operations when the downhill ski and/or tubing facilities are open.
Any person violating any of the provisions of this chapter shall be guilty of a violation and shall be subject to the following penalties:
A. 
For the first offense, a fine of at least $25, up to a maximum fine of $250.
B. 
For the second offense, a fine of at least $50, up to a maximum fine of $250.
C. 
For the third offense, a fine of at least $100, up to a maximum fine of $250.
D. 
For the fourth offense, a fine of at least $200, up to a maximum fine of $250.
E. 
For each offense thereafter, a fine not to exceed $250.
