The regulations established by this chapter shall apply to all navigable waters located within the boundary lines of the Village of Saranac Lake, except when the provisions thereof are in conflict with the laws or ordinances of the United States, the State of New York or any municipal corporation or administrative authority thereof, having jurisdiction thereover.
All provisions of the Navigation Law of the State of New York and all laws, rules or regulations enacted by Congress or promulgated by authority granted by Congress and governing the navigation of the inland waters of the United States shall be complied with by all boats using the navigable waters within the boundary lines of the Village of Saranac Lake.
As used in this chapter, the following terms shall have the meanings indicated:
BOAT or VESSEL
Every description of watercraft or other contrivance used or capable of being used as a means of transportation in water.
MOTORBOAT
Any vessel propelled in whole or in part by an engine or motor whether in-board or out-board.
OWNER
The person under whose name the vessel was last registered with the New York State Conservation Department, and in any other case the last known owner.
No person shall operate a boat at a speed in excess of 10 miles per hour on the navigable waters within the Village of Saranac Lake, except on that portion of Lake Flower within said Village which lies southerly of a line from the point where the Essex County — Franklin County line intersects the northerly shore of Lake Flower and thence westerly to the shores of Lake Flower at Riverside Drive, where it shall be lawful to operate a boat at a speed not in excess of 30 miles per hour, subject, however, to the provisions of the Navigation Law of the State of New York.
No person shall operate a boat while under the influence of intoxicating beverages, narcotics or opiates.
Every boat in the navigable waters of the Village of Saranac Lake which becomes a menace to navigation, or unseaworthy, or sinks, grounds or becomes otherwise disabled, is hereby declared to be a nuisance, and the person in charge thereof shall abate the nuisance within two days after notice from the Village Board.
Persons in charge of or occupying a boat docked at or moored to land, dock, piers or wharves abutting navigable waters shall observe all health and sanitary regulations of the Village of Saranac Lake. Discharging of toilets or of oil in the navigable waters of said Village is prohibited.
No person shall ride on water skis, a surfboard or similar device, or operate a boat to tow a person thereon in the navigable waters within the limits of the Village of Saranac Lake, except on that portion of Lake Flower that lies southerly of a line between the point where the Essex County — Franklin County line intersects the northerly shores of Lake Flower and a point on the Riverside Drive shore of Lake Flower that is due west of the first mentioned point.
Any person violating any of the provisions of this chapter shall be deemed guilty of the offense of disorderly conduct and shall be a disorderly person, and, upon conviction thereof, shall be fined in an amount not exceeding $100 or be imprisoned for a period not exceeding 60 days, or be both so fined and imprisoned. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.

A. 
No boat, vessel, motorboat or other watercraft shall be docked, moored, tied to or secured to the Village boat docks located at Riverside Park, nor at any other property owned by the Village between the hours of 10:00 p.m. through 6:30 a.m.
B. 
Penalties and fines. Any violation of this section shall be punishable as an infraction with penalties and/or fines to be imposed as follows:
(1) 
First conviction, punishable by a fine not to exceed $10.
(2) 
Two or more convictions, punishable by a fine not to exceed $50.
C. 
Removal and impoundment. Whenever any Police Officer or other Enforcement Officer of the Village finds a boat, vessel, motorboat or other watercraft parked, docked, moored, tied to or secured to the Village boat docks, and/or at any other Village property, in violation of this section, such officer shall be authorized to move such boat, vessel, motorboat or other watercraft, or require the driver or other person in charge thereof to move the same. In the event that the boat, vessel, motorboat or other watercraft is unattended, or the driver or person in charge thereof refuses to move such boat, vessel, motorboat or other watercraft to a place of impoundment, the owner or other person lawfully entitled to the possession of such boat, vessel, motorboat or other watercraft shall be charged with the reasonable cost for removal and storage, payable before the boat, vessel, motorboat or other watercraft is released.
