There is hereby created the position of independent auditor for the Borough of Taylor.
Said independent auditor shall be a certified public accountant or public accountant registered in the Commonwealth of Pennsylvania.

Said independent auditor shall make an independent examination of the accounting and financial records of the Borough of Taylor. The independent auditor shall examine, audit, and settle all accounts whatsoever in which the Borough is concerned, and the audit shall consist of an examination in accordance with generally accepted auditing standards and shall include such tests of the accounting records and such other auditing procedures as he considers necessary in the circumstances.

The independent auditor shall audit the accounting records of the Borough of Taylor and shall prepare a report on the examination which shall set forth:
A. 
The scope of his examination;
B. 
His opinion of the fairness of the presentation of the financial statement of the Borough which shall show a complete statement of the financial condition of the Borough, giving in detail the actual indebtedness, the amount of the funded debt, the amount of the floating debt thereof, the valuation of taxable property therein, the assets of the Borough with the character and value thereof, and the date of maturity of the respective forms of funded debt thereof; and
C. 
Such other duties as may be prescribed by the Act of 1966, February 1, 1965, No. 581, § 1196,[1] defining the duties of an independent auditor.

The independent auditor shall prepare all financial reports as may be required of boroughs by the Commonwealth of Pennsylvania.

The purpose of this article is to create a form of organization wherein Council shall be responsible primarily for legislative policy-making and shall appoint a Borough Manager who shall be responsible for the conduct of the administrative affairs of the Borough in a professional manner.
The position of Borough Manager is hereby created. The Manager shall be appointed for an indefinite term by a majority of all the members of Council.
The Borough Manager shall be chosen solely on the basis of his or her executive and administrative qualifications, with special reference to his or her training and/or experience in municipal management or his knowledge of accepted practices in respect to the duties of his office as herein outlined.
Before entering upon his duties, the Manager shall give bond, in the sum established annually pursuant to a resolution of Council, with a bonding company as surety, to be approved by Council, conditioned upon the faithful performance of his/her duties, the premium for said bond to be paid by the Borough.
The compensation of the Borough Manager shall be fixed from time to time by Council.
A. 
The Borough Manager shall be the chief administrative officer of the Borough, and shall be responsible to Council, as a whole, for the proper and efficient administration of the affairs of Taylor Borough placed in his/her charge. The powers and duties for administration of all Borough business shall be vested in the Manager, unless expressly imposed or conferred by statute or ordinance upon other Borough officers. He or she shall:
(1) 
Be responsible to Council for carrying out all policies and programs established by Council.
(2) 
Direct and supervise the administration of all departments, and offices of the Borough, except as otherwise provided by law.
(3) 
Prepare or require to be prepared for appropriate approval, purchase orders or other documents, dealing with the disbursement of funds appropriated by Council and report to Council on such disbursements at work sessions and/or regularly scheduled Council meetings.
(4) 
Recommend to Council, when requested, the hiring or appointment of employees under his/her supervision and, when he or she deems it necessary for the good of the Borough, suspend, with or without pay, any employee under his/her supervision; provided that if the person is covered by the civil service provisions of the Borough Code or collective bargaining agreements, same shall be hired, suspended, or discharged in accordance with such provisions; and provided, further, that the Manager shall report, at the next work session or meeting thereafter of Council (whichever occurs first), any action taken by authority of this subsection. The Borough Manager shall have the authority to employ such part-time or temporary employees as are deemed necessary and shall immediately report same to the Borough Council at its next work session or meeting, whichever occurs first. This subsection shall not apply to the Borough Solicitor, Borough Engineer, or Borough Treasurer.
(5) 
Make such recommendations to Council concerning policy formulation as he or she deems desirable.
(6) 
Prepare and submit to Council an annual budget for the next fiscal year and an explanatory budget message in such a timely fashion as will enable Council to consider and adopt the budget and related tax ordinances according to the requirements of law. In preparing the budget, the Manager, or an officer designated by him/her, shall obtain from the head of each department, agency, board, commission, authority or any qualified officer thereof estimates of revenues and expenditures and such other supporting data as is required. The Manager shall review such estimates and may revise them before submitting the budget(s) to Council.
(7) 
Prepare the agenda and attend all meetings of Council, and supply facts pertinent thereto. Prepare all notices of meetings of Council, committees thereof, or committees or commissions established by the Council.
(8) 
Keep Council and the public informed as to the conduct of Borough affairs; submit periodic reports on the condition of Borough finance and such other reports as the Council requests; and make such recommendations to the Council as he/she deems necessary.
(9) 
Submit to Council, as soon as possible after the close of the fiscal year, a complete report on the finances and administrative activities of the Borough and/or an annual report for the preceding year.
(10) 
See that the provisions of all franchises, leases, permits, and privileges granted by Council are observed.
(11) 
Attend to the letting of contracts for the Borough and, after authorization, secure the execution thereof on behalf of the Borough upon the prior approval of Council as authorized by law.
(12) 
Be responsible for all accounts payable and receivable, not specifically assigned to the Borough Treasurer, or otherwise provided under the Borough Code, or by law.
(13) 
Serve as Purchasing Officer for the Borough of Taylor and purchase, in accordance with the provisions of the Borough Code and state law, all supplies and equipment for the agencies, boards, departments, and other offices of the Borough of Taylor. The Manager shall keep an account of all purchases and shall, from time to time or when directed by Council, make a full written report thereof. He/she shall also issue rules and regulations subject to the approval of Council, governing the procurement of all municipal supplies and equipment. The Manager may purchase replacements and/or emergency supplies/equipment and may make new purchases to a limit and as authorized by Borough resolution.
(14) 
Investigate and dispose of, or designate an officer to investigate and dispose of, all complaints regarding Borough services and personnel and to report to Council thereon. All complaints regarding Borough services shall be referred to the office of the Manger.
(15) 
Enforce the ordinances and regulations of the Borough of Taylor as assigned by Council or ordinance.
(16) 
Serve as the recording secretary to the Borough’s Planning Commission.
(17) 
Manage and make recommendations relating to the Borough’s telecommunications and computer assets.
(18) 
Serve as liaison and/or represent Borough Council with private, public and other groups, organizations, and/or individuals.
(19) 
Prepare and submit and/or prepare for the signature of Council President all federal, state, and county reporting requirements.
(20) 
Prepare and maintain a Borough records management system in accordance with state guidelines.
(21) 
Pursue, prepare, and complete available grants and alternative funding sources, as approved by Council.
(22) 
Prepare and maintain a Borough human resource management system, in accordance with law, to include payroll actions and related tax issues.
(23) 
Develop and advertise requests for proposals (RFPs) as approved by Council.
(24) 
Serve as the day-to-day liaison with the Borough Solicitor, special solicitor(s), Borough Engineer, Borough Sewerage Enforcement Officer, Borough Codes Officer, independent auditor(s) and appointed and elected tax collectors on behalf of Council.
(25) 
Review, maintain and make suggestions relating to the Borough’s Police and Nonuniformed Pension Plans, and take those administrative actions in support thereof.
(26) 
Review, maintain and make suggestions relating to the Borough’s insurance policy coverage.
(27) 
Oversee and manage Borough real property, to include but not be limited to parks, buildings, infrastructure and the Community Center, subject, however, with respect to the Community Center, to the duties assigned to the Recreation Commission, regarding operations and maintenance activities, and expend Borough funds as authorized and limited by Borough resolution.
(28) 
Prepare drafts of Borough ordinances and resolutions for the review and approval of the Borough Solicitor, as required.
(29) 
Serve as the designee under Article XVII, Section 3(2), of the Memorandum of Understanding between the Borough and the Police Officers Association and Article III, Section 2, of the Agreement Between the Borough and the Service Employees Union, together with amendments thereto.
(30) 
Serve as the liaison and principal contact for the Borough’s Commercial Driver’s License (CDL) Testing Program.
(31) 
Do legal advertisements and insure posting as required of the Borough’s Zoning Hearing Board.
(32) 
Perform such other duties as are designated by Council.
The Mayor is hereby authorized to delegate to the Borough Manager, with the approval of the Council, subject to recall by written notification at any time, any of his nonlegislative or nonjudicial powers and duties as allowed by law.
In the event the Borough Manager becomes ill or is absent, Council at any time appoint another person to the position of Acting Manager to serve until the Manager returns or until his or her disability ceases.
Except for the purpose of inquiry, Council and its members shall deal with employees solely through the Borough Manager, and neither Council nor any member shall give orders to a subordinate of the Manager.
