From and after the passage of this chapter, it shall be unlawful for any person under the age of 18 to be or remain in or upon the streets, highways, alleys, parks or other public places in the Township of Tinicum at night, between the hours of 9:30 p.m. and 5:00 a.m., prevailing time, Sunday through Thursday, and between the hours of 10:00 p.m. and 5:00 a.m., prevailing time, Friday and Saturday, unless such person is accompanied by a parent, guardian or other person having the legal custody or care of such person or is accompanied by a responsible person of good repute over the age of 21.
It shall be unlawful for any parent, guardian or other person having legal custody or care of any such person under the age of 18 to allow or permit any such person under the age of 18 to go or be in or upon any street, highway, alley, park or public place in the Township of Tinicum between the times prohibited in § 117-1 of this chapter.
The police officers of the Township of Tinicum, in taking a person under the age of 18 into custody, shall use their discretion in determining age, and, in doubtful cases, police officers may require positive proof, and until such proof is furnished, the police officer's judgment shall prevail.
Any person under the age of 18 found upon the streets, highways, alleys, parks or other public places within the Township of Tinicum in violation of the provisions of this chapter may be taken into custody by a member of the Police Department of the Township of Tinicum. Any person under the age of 18 found to be in violation of this chapter shall be subject to a minimum fine of $25 and a maximum fine of $600. The parent, guardian or legal custodian of any person under the age of 18 found to be in violation of this chapter shall also be subject to a minimum fine of $25 and a maximum fine of $600.
