When used in this chapter, the meaning of the following words shall be as designated below:
BOARD
The Board of Commissioners of Tinicum Township.
PERSON
Any person, persons, partnership, association, firm or corporation or may be extended to include a duly authorized agent of any of them.
ROAD
Road, street, lane or alley.
SEWER
Unless specifically designated as storm or sanitary, shall mean any sewer or drainage facility.
TOWNSHIP
The Township of Tinicum.
TOWNSHIP PLAN
A plan of the Township of Tinicum showing existing streets, and any approved streets duly approved by the Board, and may refer to any subplan thereof when properly approved.
Before any person shall open or dedicate any road for public travel or use, or construct any sewer in connection therewith in the Township, he shall first submit plans therefor to the Board for their approval and no road or sewer shall be opened or constructed except in strict accordance with plans approved by the Board.
Such plan shall show:
A. 
The general layout of all proposed streets in the tract to be developed, giving their alignment with location of monuments and with reference to connecting or contiguous roads, either actually existing or shown on the Township Plan as "proposed."
B. 
Profiles of such roads.
C. 
The course, structure and capacity of any proposed sewers, together with profiles.
D. 
The method of drainage of the whole property and its relation to the method of drainage of the adjacent or contiguous territory.
E. 
Lot sizes.
F. 
Location of any proposed streetlights.
G. 
Location of any fire hydrant.
All roads shall be of a width not less than 45 feet, the cartway shall be not less than 24 feet and all roads connecting with existing roads so as to form a continuation or extension thereof shall be not less in width than such existing roads, or where a road is laid out in general conformity to a street shown as proposed on the Township Plan and shown to be in excess of the above minimum in width, the said road shall not be less in width than the proposed street shown on the Township Plan.
All roads, where possible, shall connect with existing roads or proposed roads as shown on the Township Plan so as to form, as nearly as possible, through roads and a harmonious and systematic development of the Township. The names of roads shall not conflict with the names of existing roads nor be so similar as to be unnecessarily confusing, and all roads laid out as actual or potential extensions of existing roads shall be designated by the names of those existing roads. Provision shall be made for the erection of at least one street sign at each newly formed intersection. These name signs shall be of a design approved by the Highway Committee of the Board.
All applications for the approval of plans to open any road or construct any sewer shall be in writing on a blank form to be furnished for that purpose by the Board, signed by the owners of the property or a duly authorized representative and shall be filed with the Secretary of the Township at least 10 days prior to the regular meeting of the Board at which it is desired to seek approval thereof. The said application shall set forth in detail the character of the improvements to be made, and the applicant shall therein agree:
A. 
That all construction work shall be subject to the direction and supervision of the Township Engineer or an inspector whom he may place in charge of the work, and that the construction of all improvements will be completed in a proper and workmanlike manner and in accordance with Township specifications, and that an allowance of $10 per day for each day of actual construction, to cover the salary of said inspector, shall be borne by the applicant.
B. 
That all authorized Township employees or agents may enter upon the lands of the applicant for the purpose of inspection and supervision.
C. 
That all stakes necessary for line or grade for construction shall be secured by arrangement with the Township Engineer and at the expense of the applicant.
D. 
That all cement, stone, asphalt, pipe, castings or other materials used in the proposed construction shall be in accordance with specifications established by ordinance or approved by the Highway or Sewer Committee of the Board.
E. 
That the Board will not be asked to accept any improvement except upon tender of formal deed of dedication to the Township, accompanied by any necessary right-of-way through private property, in form approved by the Township Solicitor, together with a certificate from the contractor that said improvement has been paid for in full and a certificate from the Township Engineer that all conditions pertaining to its construction either by ordinance or special agreement have been complied with.
F. 
That no ditch will be opened in, nor any material disposed of or placed within, any public street of the Township unless a permit for the same shall have been previously obtained.
G. 
That he will be responsible for any and all loss, damage, claim or demand in any way arising by reason of the construction of said improvement and will indemnify and save the Township harmless therefrom and, if required so to do by the Board, will provide approved security for that purpose.
H. 
That if required by the Highway or Sewer Committee of the Board he will provide a bond with approved security or cash indemnity to assure the completion of all or any part of the proposed improvements, roads or sewers within the time or times therein specified, in strict conformity to this chapter or any agreement hereunder.
I. 
That no lot abutting an any proposed road will be sold as such or built upon unless and until the improvements have been entirely completed in a manner acceptable to the Board, or a bond for completion has been filed as above provided.
J. 
That no connection of any dwelling house or other building to any sanitary sewer shall be permitted to be made prior to acceptance of said sewer by the Township, and subsequent connections shall be subject to the regulations of the Township and their use thereafter shall be regulated by Township ordinance,[1] at established service rates.

K. 
That there shall be paid to the Township the sum of $0.50 per foot for each foot of sanitary sewer built in any existing or proposed road as a contribution towards the cost of the outfall sewers of the Township.
L. 
That in no case shall any sewer be connected to the main sewer until the work has been completed and the sewer is watertight throughout its entire length and approved by the Sewer Committee and accepted by the Board. Such connection, including a manhole where necessary, shall be made by the Township at the applicant's expense.
M. 
That nothing contained in any application relative to the construction of any sewer, and no act of the Township or its employees or agents done pursuant thereto, shall be taken or construed as in any way affecting the status of any private road in which such sewer right-of-way shall or may be, or as an acceptance or taking over of such road as a public road.
The Board reserves the right to alter any plan submitted for approval and to specify any changes or modifications of any kind which it may deem necessary with respect thereto and to make its approval of such plans subject to any such alterations, changes or modifications. Before acting upon any such plans, the Board may, in its discretion, arrange for a public hearing, after giving such notice as it deems desirable.
Any and all plans, when approved, shall be signed in duplicate on behalf of the Township by the President of the Board, the Township Seal affixed, duly attested by the Secretary and one copy shall be filed in the office of the Board, where the same shall be available for public inspection. But the approval of any plan of streets shall not imply any obligation on the part of the Board to accept these streets as public roads unless the improvements therein are completed in strict accordance with all ordinances of the Township and all rules and regulations promulgated under such ordinances.
A duplicate set of such plans, showing they have been duly approved, shall be recorded by the person applying for such approval in the office for the recording of deeds in and for the County of Delaware, Pennsylvania.
All roads with curbs and other improvements shown on the said plan shall be built of one of the standard types of material specified by ordinance for public roads, curbs, etc., in the Township or approved by the Township Engineer and by the Board.
All sewers, sewer laterals, water, gas or other service mains, together with house connections to all or any of them where it is proposed to install any such service, shall be laid before the paving of the cartway is commenced. The Commissioners reserve the right to refuse a permit to open any penetration macadam or bituminous concrete street within three years from its installation, or any concrete street within five years, except in cases of unusual emergency.
The minimum requirements for curbing shall be six-inch-by-eighteen-inch portland cement concrete. Sidewalks shall be four feet in width and four inches in depth, portland cement concrete, and roadway six inches broken-stone base and two inches bituminous concrete wearing surface, all in accordance with specifications on file at the office of the Township Engineer.
