The purpose of this chapter is to protect the health, safety, morals and welfare of the citizens of the Township of Tinicum by prohibiting the storage of abandoned, wrecked, junked or stripped automobiles on private property, since storage of the same is detrimental to the health, safety, morals and welfare of the citizens of Tinicum Township.
It shall be unlawful to park, store or leave any vehicle of any kind in a wrecked, junked, stripped or abandoned condition in a place where its presence constitutes a hazard to the citizens of the Township or for the owners of such automobiles or vehicles or the owners or occupiers of any property to allow, permit or suffer the same to be left upon any privately owned property unless the same be authorized in conjunction with a business properly operated pursuant to the zoning laws of the Township of Tinicum.[1]

When any person shall complain to the Secretary of the Township that this chapter is being violated, he shall immediately convey such information to the Police Commissioner of the Township and, if the Police Commissioner believes that there is proper cause for the complaint, he shall cause the Secretary to send a notice of the alleged violation to the owners or occupiers of the land upon which the nuisance exists, notifying them to abate the nuisance by removing the vehicles within 10 days after notice; said notice to be given personally or by certified mail.
The person upon whom notice has been served of the violation of this chapter may, within five days after receipt of the same, request a hearing before the Police Committee and after said hearing the Police Committee shall affirm, withdraw or modify the violation notice. The intent to request a hearing shall be in writing, addressed to the Township Secretary, and notice of the date of the hearing shall be sent to all affected parties.
If the violation complained of shall not be eliminated within the time set forth in the original notice or within such time as may be determined by the Police Committee after hearing, the owners or occupiers of the premises upon which said nuisance exists shall be deemed to be in violation.
The Police Commissioner or the Chief of Police is hereby authorized to represent the Township in the prosecution of any person charged with the violation of this chapter.
Any person who shall violate any section of this chapter shall, upon conviction before any Magisterial District Judge of the Township of Tinicum, pay a fine of not less than $10 nor more than $300 and costs of prosecution or, in default thereof, undergo imprisonment for a period not exceeding 30 days. Each day's failure to comply with the order of the Police Committee shall constitute a separate offense.
