From and after the passage of this chapter,
it shall be unlawful for any transient person or persons, firm or
corporation to sell or offer for sale or to hawk, huckster, peddle
or offer for sale, either on foot or in any wagon or vehicle or in
any other manner whatsoever, at retail, any article or object of merchandise
within the limits of the Township of Tinicum, without first obtaining
a license for such purpose from the Secretary of the Board of Township
Commissioners, for which license each such applicant shall pay the
following fee:
No person engaged in any transient retail business licensed under §
179-1 shall:
A. Sell any
product or type of product not mentioned in his license.
B. Hawk or
cry his wares upon any of the streets, alleys, sidewalks or public
grounds in the municipality.
C. When operating
from a vehicle, stop or park such vehicle upon any of the streets
or alleys in the municipality for longer than necessary in order to
sell therefrom to persons residing or working in the immediate vicinity.
D. Park any
vehicle upon any of the streets or alleys in the municipality for
the purpose of sorting, rearranging or cleaning any of his goods,
wares or merchandise or of disposing of any carton, wrapping material
or stock, wares or foodstuffs which have become unsalable through
handling, age or otherwise.
E. Engage
in any business activity, except as provided by permit, at any time
on a Sunday or legal holiday or at any time before 9:00 a.m. or after
6:00 p.m. on any day of the week other than a Sunday or legal holiday.
F. Engage
in any business activity along municipal streets without first contacting
the Code Enforcement Officer and the Chief of Police in order to determine
if adequate and safe off-street parking with proper sight distance
at the point of ingress and egress is available and without first
obtaining all necessary permits from Pennsylvania Department of Transportation
for state thoroughfares.
It shall be unlawful for any such person in
making any such sale or attempting the same to call at any private
residence without first having been invited by a legal occupant of
said residence, and any violation of this provision is hereby declared
a nuisance and may be punished as such.
Each license shall particularly specify the
time for which it is granted and the nature of the business the applicant
desires to pursue. The license shall be numbered, and the person or
persons holding such license shall be required to place the number
of said license on the right-hand side of any vehicle used in the
said business in as conspicuous a place as possible. Said person shall
at all times carry the license with him and produce the same upon
request of any police officer or other peace officer of the Township.
All license fees under this chapter shall be
paid to the Secretary of the Board of Commissioners, who shall make
return of the money so received to the Township Treasurer each and
every month and shall pay such money at such times to the Township
Treasurer.
Any person or persons violating any provisions
of this chapter shall, upon conviction thereof before any Magisterial
District Judge of the said Township, forfeit and pay a fine of not
more than $600, plus costs of prosecution, and, in default of payment
of such fine and costs, be subject to imprisonment in the county jail
for a period not exceeding 30 days.
