Any vehicle parked on a street or highway or on public property of the Township of Tinicum in violation of any ordinance of the Township of Tinicum shall be removed and impounded at a garage which has been approved by the Township Commissioners and has qualified in accordance with § 373-3 of this chapter.

Any vehicle removed and impounded pursuant to the authority of this chapter shall be stored at a garage having qualified as a storage garage under § 373-3 of this chapter and having been approved by the Township Commissioners.
In order to qualify as a storage garage for impounded vehicles, the owner of the garage shall post a bond in the sum of $5,000 for the indemnifying of the owner of such impounded vehicles against the loss thereof or injury or damages thereto while in the custody of such poundkeeper.

The charge for towing any vehicle shall be $25 per vehicle. The charge for storing any vehicle shall be $3 per day. Payment shall be made to the owners of the garage and/or towing vehicle, as the case may be.
Within 12 hours from the time of removal of a vehicle, notice of the fact that such vehicle has been impounded shall be sent by the Police Department to the owner of record of such vehicle, designating the place from which said vehicle was removed, the reason for its removal and impounding and the pound in which it has been impounded.
The payment of towing and impounding charges, unless such payment shall be made under protest, shall be final and conclusive and shall constitute a wavier of any right to recover the money so paid.
In the event that the towing and impounding charges are paid under protest, the offender shall be entitled to a hearing before a Magisterial District Judge, who shall send the offender, by registered mail within five days after payment of the charges, written notice of the hearing. The notice shall require the offender to appear within 10 days of the date of notice.
Any person proceeded against pursuant to § 373-7 shall have the right to appeal the Magisterial District Judge's decision to the Court of Quarter Sessions.
Any person proceeded against pursuant to § 373-7 shall have the right to waive the Magisterial District Judge's hearing and appeal the payment of the charges to the Court of Quarter Sessions.
