The area between the curbline or paving line
and the nearest public right-of-way line of any public street in the
Township of Tinicum shall at all times be kept clear of obstructions
other than sidewalks, public utility facilities, authorized signs,
trees, shrubs and other plantings; and no merchandise or vehicles
may be displayed, parked or stored therein, nor may any fence or structure
be erected therein.
The Board of Commissioners may, upon application,
grant exceptions to this article for fences or similar structures
heretofore erected, where the Board finds that such structures do
not impede public travel and do not constitute a safety hazard to
pedestrians or motorists. Under the same conditions, the Board of
Commissioners may grant exceptions to this article for fences or similar
structures to be erected which are in line with such existing fences
or structures on the street involved. Any exceptions shall be temporary
and may be revoked without liability for damages at any time.

Any person violating this article after having
once been warned to cease such violation shall be sentenced to pay
a fine of not more than $600, plus costs of prosecution, and, in default
of payment of such fine and costs, to imprisonment in the county jail
for a period not exceeding 30 days. Each day the violation continues
and each vehicle or item is stored, parked or displayed shall constitute
a separate offense.
