All sidewalks in the Borough of Derry, Westmoreland County, Pennsylvania, shall be paved by the abutting property owner or owners.
All sidewalks, not already paved with other material, shall be paved with concrete at least four inches thick. All sidewalks shall conform strictly to the requirements pertaining to the line and grade obtained by the property owner from the Borough Engineer, and the middle of all sidewalks laid pursuant to this article shall be an equal distance from the inside of the curb and from the property line, and the elevation of the outer line of said sidewalks shall conform as nearly as possible to the elevation of the adjoining curb, except where Council grants special permission to construct the same at a different elevation, and said sidewalks shall raise one-quarter inch per foot for the full width of the walk; and the concrete used shall consist of a mixture of at least four parts gravel or aggregate, two parts sand, and one part cement.
Any property owner, upon his own initiative, and without notice from any Borough authority, but after five days' notice to the Derry Borough Street Commissioner, may construct, reconstruct or repair a sidewalk in front of or alongside his property, provided that such owner shall first make application to the Borough Engineer for the line and grade, and shall conform to all the requirements of this article; and shall construct the same under the supervision of the Derry Borough Street Commissioner, particularly with respect to alignment, width, elevation, mixture and thickness. The Street Commissioner shall have authority to stop the work in any case where in his opinion it is not being done in accordance with this article, and any work which is not satisfactory to the Street Commissioner, and the Street Committee of Council, shall be removed and relaid at the expense of the abutting property owner or owners, in accordance with the provisions of this article.

With the exception of South Chestnut Street from Third Avenue to First Avenue; First Avenue from Y Street to South Ligonier Street; Second Avenue from Y Street to South Ligonier Street; South Ligonier Street from First Avenue to Second Avenue; and Second Street from North Chestnut Street to North Ligonier Street, on the north side of the street, where sidewalks shall extend from the curb to the property line, new sidewalks shall be five feet in width, except where streets are 24 feet or less in width, in which case the sidewalks shall be four feet in width, and except in cases where Council, because of local conditions, permits the construction of a sidewalk of different width.
If any property owner shall, within the time designated by Council, fail, neglect, or refuse to construct, reconstruct or repair a sidewalk, or having undertaken any such work, shall fail to conform to all applicable requirements set forth in this article, the Borough of Derry shall have the authority to construct, reconstruct or repair such sidewalk, or to complete or rectify any work undertaken, and the Borough shall collect the costs of such work, with an additional charge of 10% thereof, by assessing the costs thereof against the property, and the Borough shall enter a lien therefor and collect the same from the property owner or owners, as provided by law, or the Borough may collect the same under any manner authorized by law.
Existing sidewalks, other than concrete, may be repaired, improved or extended with the same materials.
