Editor's Notes: The preamble to Ordinance 520 stated that Act No. 511, the Local Tax Enabling Act, as amended and supplemented, was the authority for enactment of this tax; Section 7 of the ordinance stated that this tax would continue in full force and effect each and every year thereafter, without annual reenactment.
Any individual, firm, partnership or corporation desiring to operate or continue the operation of any place of business where food vending machines, candy vending machines, cigarette vending machines or soft drink vending machines are maintained within the Borough limits shall make application in writing to the Borough, specifying the nature and character of the business and the location of the same, and the food vending machines, candy vending machines, cigarette vending machines, or soft drink vending machines desired to be operated. The Borough shall thereupon investigate, and if it deems it proper to be carried on at the location of the same specified, shall direct that a license be issued by the Borough Secretary for the operation or the continued operation of said business, upon the payment of the charges as hereinafter set forth.
A license fee for general revenue purposes is hereby assessed upon the privilege of using for profit within the Borough of Derry, any vending machine as follows:
A. 
On each food vending machine, coffee vending machine, candy vending machine, the sum of $10 per year, or any fractional part thereof.
B. 
On each cigarette vending machine, the sum of $10 per year, or any fractional part thereof.
C. 
On each soft drink vending machine, the sum of $10 per year, or any fractional part thereof.
The license fees herein imposed shall be recoverable by the Borough as other debts of like character are now by law recovered.
All fees, interest and penalties received, collected or recovered under the provisions of this article shall be paid into the Treasury of the Borough of Derry for the use and benefit of the Borough of Derry.
Any individual, firm, partnership or corporation who shall fail, neglect or refuse to comply with the terms or provisions of this article or the payment of any license fee required hereunder shall, upon conviction before a Magisterial District Judge, be sentenced to pay a fine of not less than $25, nor more than $300 and costs for each offense, and in default of payment thereof, be sentenced and committed to the Borough lockup for a period not exceeding 10 days, or to the county jail or workhouse for a period not exceeding 30 days.
