A certain document, a copy of which is on file in the office of the Borough Secretary of the Borough of Port Allegany, being marked and designated as the "BOCA National Building Code," particularly the 1993 Edition and subsequent editions as are from time to time recommended and maintained by the Building Official and BOCA International, Inc., be and is hereby adopted as the Building Code of the Borough of Port Allegany in the State of Pennsylvania for the control of buildings and structures within the corporate limits of the Borough of Port Allegany, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any.

Modifications to the standard code adopted by § 42-1 are as follows:
A. 
Section 121.2, Membership of Board (Board of Appeals), is hereby amended to change the number of members from five to three.
B. 
Section 121.2.1, Qualifications (Board of Appeals), is hereby deleted, since not enough individuals with such qualifications are available in the borough for service on the Board.
A. 
The office of Building Official is hereby created, and the executive official in charge shall be known as the Building Official.
B. 
The Building Official shall be appointed by the Port Allegany Borough Council. His appointment shall continue during good behavior and satisfactory service. He shall not be removed from office except for cause after full opportunity has been given him to be heard on specific charges.
C. 
During temporary absence or disability of the Building Official, the appointing authority shall designate an Acting Building Official.[1]

It shall be the duty of the Building Official to enforce all laws relating to the construction, alteration, removal and demolition of buildings and structures.
The Building Official, in the discharge of his office and upon proper identification, shall have authority to enter any building, structure or premises at any reasonable hour.
As used in this chapter, the following terms shall have the meanings indicated:
CORPORATE COUNSEL
The solicitor for the Borough of Port Allegany.
MUNICIPALITY
The Borough of Port Allegany.
The fire limits of the Borough of Port Allegany are hereby defined to be on both sides of Mill Street in said borough from Willow Street to the tracks of the W.N.Y. & P.R.R. (now the P.R.R.) and on the north side of Mill Street from said P.R.R. tracks to a point 10 rods southwest from Barrett Alley on Mill Street and on both sides of Main Street from Arnold Avenue to Lillibridge Creek and on both sides of Pearl Street from Mill Street to Maple Street, the fire limits to be as aforesaid and to extend 1/2 square in depth where there is a street parallel with the street along which the fire limit extends, and to extend 15 rods in depth where there is not such parallel street.
A. 
No permit or amended permit as required by the Building Code shall be issued until the fee prescribed in this chapter shall have been paid.
B. 
The Port Allegany Borough Council shall establish by resolution a schedule of fees to be charged for the issuance of building permits; such schedule to be posted on a bulletin board in a conspicuous place at the office of the Borough Secretary.

Any person who shall violate any of the provisions of this chapter or who shall fail to comply herewith shall, upon conviction before a District Magistrate, be guilty of a summary offense and shall be fined in an amount to be set by the Court, plus costs of prosecution pursuant to law. In the event the fine and costs are not paid, the defendant shall be sentenced to serve not more than 30 days and in the McKean County Jail. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
