GENERAL REFERENCES
Vehicles and traffic — See Ch. 94.
This chapter shall be known as the "Law Regulating and Restricting Abandoned Vehicles Within the Borough."
As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED MOTOR VEHICLE
A. 
A vehicle (other than a pedacycle):
(1) 
That is operated and is left unattended on public property for more than 48 hours;
(2) 
That has remained illegally on public property for a period of more than 48 hours;
(3) 
Without a valid registration plate or certificate of inspection or title left unattended on public property; or
(4) 
That has remained on private property without the consent of the owner or person in control of the property for more than 48 hours.
B. 
Vehicles and equipment used or to be used in construction or in the operation or maintenance of public utility facilities which are left in a manner which does not interfere with the normal movement of traffic shall not be considered to be abandoned.
JUNKED OR INOPERABLE MOTOR VEHICLE
Any motor vehicle which is no longer in actual use as a motor vehicle or which is wholly unfit to be operated and as to which any of the following conditions exist:
A. 
It has been so damaged by collision, accident or other means that it is inoperable.
B. 
It does not have all of its material parts, including but not limited to four tires and wheels, required head lamps and tail lamps, windshield, radiator, transmission, engine, rear windows and doors.
C. 
It is inoperable for any other reason.
PERSON
Any individual, firm, company, association, society, corporation or group.
A. 
It shall be unlawful for any person to cause a motor vehicle to be abandoned in or upon any public right-of-way, public parking area, public recreational facility or any other public property.
B. 
Nothing herein shall prohibit any person from parking, storing or repairing a motor vehicle upon public property where authorized under the laws of the Commonwealth of Pennsylvania.
A. 
The person responsible shall remove the abandoned, junked or inoperable vehicle from public property within 72 hours after written notice from the Police Department.
B. 
Written notice for removal shall be given to the owner or operator of the abandoned, junked or inoperable vehicle by:
(1) 
Personal notice.
(2) 
Certified mail, return receipt requested.
(3) 
Notice securely placed on the vehicle if owner cannot be ascertained.
C. 
The date of notice shall be construed to be the date on which the notice was personally served or mailed, except when the notice has been placed on the vehicle, in which case a twenty-four-hour extension will be granted.
Once removed from public property it shall be unlawful for any abandoned, junked or inoperable motor vehicle to be returned to public property unless or until it bears current, legal registration plates for such vehicle and a valid certificate of inspection.
A. 
Any person who shall violate any provision of this chapter may be subject to a fine, for the first offense, of not less than $50 and costs, and upon subsequent convictions, not more than $300 and costs.
B. 
Each day the violation continues shall be construed as a separate violation.
C. 
Default in payment of the adjudged fine and costs will result in imprisonment for not more than 30 days.
This chapter shall take effect immediately upon advertising pursuant to law and upon enactment by the Borough Council.
