The purpose of this chapter is to promote the health and well-being and safety of the residents of the Village of Soldiers Grove.
As used in this chapter, the following terms shall have the meanings indicated:
OUTDOOR WOOD FURNACE
An outdoor device designed or constructed for solid fuel combustion so that the usable heat is derived for the interior of buildings. Construction of an enclosure for said device shall not change its character as an outdoor device subject to this chapter.
An outdoor wood-fired furnace may be installed and used in the Village of Soldiers Grove only in accordance with the following provisions:
A. 
The outdoor wood-fired furnace shall not be used to burn any of the prohibited materials listed in this chapter in § 154-4.
B. 
The outdoor wood-fired furnace shall be located at least 30 feet from all existing property lot lines.
C. 
The outdoor wood-fired furnace shall have a chimney that extends at least 15 feet above the ground surface and have a spark arrestor.
Materials that may not be burned consist of the following:
A. 
Rubbish or garbage including but not limited to food wastes, food wraps, packaging, animal carcasses or feces, paint or painted materials, furniture, composite shingles, construction or demolition debris or other household or business wastes.
B. 
Waste oil or other oily wastes except used oil burned in a heating device for energy recovery subject to the restrictions in Chapter NR 590, Wisconsin Administrative Code.
C. 
Asphalt and products containing asphalt.
D. 
Treated or painted wood including but not limited to plywood, composite wood products or other wood products that are painted, varnished or treated with preservatives.
E. 
Any plastic material including but not limited to nylon, PVS, ABS, polystyrene or urethane foam, and synthetic fabrics, plastic films and plastic containers.
F. 
Rubber including tires and synthetic rubber-like products.
The owner or occupant of the property shall meet with the Public Safety Committee to review the location of each outdoor wood-fired furnace. The Village Board shall have final approval before installation, and the outdoor wood-fired furnace is to be inspected after installation by the Village Fire Warden.
The existing outdoor wood furnaces shall be permitted until they are no longer operational. All replacements for these outdoor wood-fired furnaces must be applied for and approved according to this chapter. The owners of these existing furnaces shall comply with this chapter in all aspects except § 154-3B and § 154-5.
The enforcement of this chapter and all other laws and ordinances relating to building shall be by means of the withholding of building permits, imposition of forfeitures and injunctive action. Forfeitures shall be not less than $25 nor more than $1,000 for each day of noncompliance.
