Except as otherwise stated herein, all facilities and equipment
necessary for the distribution of electric, telephone, gas, television
cable, and all other utility services created, established or approved
subsequent to the effective date of this chapter shall be installed
underground. This chapter shall specifically apply to all such facilities
and equipment which increase the present capacity for distribution
of said utility services, but shall not apply to repairs and maintenance
which do not increase said capacity.
In the event the Village Board determines that compliance with the provisions of §
201-1 above are onerous or unreasonable because of adverse soil conditions, unsafe conditions or prohibitive expense, they may allow the construction and establishment of utility services to be installed above ground.
Upon the approval of the location by the Village Board, transformers,
junction boxes, meter points or other similar equipment may be installed
above ground.
In the event any utility company violates the provisions of
this chapter, that company may be subject to a fine of between $50
and $200 per day for any day in which such a violation has occurred.
